MLB.com Beat The Streak -- Official Rules
The object of this skill contest is to start a virtual "hitting streak" and keep it going for as long as possible. You'll do this by selecting one Major League Baseball ("MLB") player each day, from a list displayed on MLB.com of selected top hitters in the game that are participating in 2004 MLB regular season games on that day. If your player gets at least one hit in that day's games, your streak continues. If the player does not get a hit, you can still play, but your streak is reset to zero. You must pick a player each day; or you can make selections for up to seven (7) days in the future.
Eligibility
MLB.com Beat the Streak (the "Contest") is open to legal residents of the United States (excluding Florida, Rhode Island, Puerto Rico, Guam, U.S. Virgin Islands, all other U.S. and foreign territories and possessions), Washington D.C. and Canada (excluding the province of Quebec) (and excluding where otherwise prohibited by law, rule or regulation) 18 years of age or older with a valid Internet e-mail address as of March 30, 2004. Void where prohibited by law. Excluded residents may participate, but WILL NOT be eligible to receive any prizes. Only one entry to this Contest is permitted for any valid e-mail address.
Employees or consultants (and their immediate family members) of MLB Advanced Media, L.P. ("MLBAM"), Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions), Baseball Television, Inc. (d/b/a Major League Baseball International), the Major League Baseball Clubs, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers and employees of the above entities(collectively, the "MLB Entities") (immediate family is defined as parent, sibling or any person residing in the same household as employee or consultant) and their respective parent companies, affiliates, subsidiaries, advertising and promotion agencies are not eligible to receive prizes.
Contest Schedule
The Contest runs from March 30, 2004 to the end of the last game of the 2004 MLB regular season (the "Contest Period").
Cost
NO PURCHASE NECESSARY TO ENTER OR WIN. Register online at www.mlb.com.
Game Administration
MLBAM will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. MLBAM, in its sole discretion, will determine the MLB players who may be selected in the Contest. All decisions by MLBAM regarding the Contest shall be final and binding in all respects. HOW TO PLAY
Selecting Your Player
Each day on which an MLB game is played, you will have the opportunity to select one (1) player from a list displayed on MLB.com. If you fail to pick a player on any day, your streak will start over at zero. The list of available players may change, so be alert. You can select any player from that list.
Player Selection Deadline
The deadline for selecting your player each day is five (5) minutes prior to the start of the first MLB game being played on that day. You can enter the game at any point during the 2004 MLB regular season.
Scoring
Scoring in MLB.com Beat The Streak is simple. Your score is measured by the number of consecutive days the player(s) you select are credited with a hit during the 2004 MLB regular season.
If you select a player who does not get a hit during the day for which you selected him, your streak ends and you are free to start again from zero.
If a player you select does not play during the day for which you selected him for any reason, your streak will NOT end and will continue. A hitting streak will also NOT end if all the selected player's plate appearances (one or more) result in a base on balls, hit batsman, defensive interference or a sacrifice bunt. A hitting streak will end if the player has a sacrifice fly and no hit.
Your streak will remain intact in the event of a cancelled or postponed game.
In the event that a player you select plays in a double-header, your streak will continue as long as the player gets at least one hit in either of the two games.
NOTE: Only hits generated in official 2004 MLB regular season games will be counted in MLB.com Beat The Streak.
Leagues
You will have the option of joining a private league to compete in during the season. Participants of private leagues compete against all other Beat the Streak participants, but only participants of private leagues are able to view their streaks against the streaks of other participants within their respective private league. NOTE: PRIZES WILL NOT BE AWARDED TO WINNERS OF PRIVATE LEAGUES. Private leagues are strictly for fun and are designed to promote competition among friends and other participants of MLB.com Beat the Streak.
PRIZES
Prizes are non-transferable and non-assignable, with no cash redemptions or substitutions except due to unavailability, in which case, a cash prize of equal or greater value to the face value of the applicable prize will be awarded at the exclusive discretion of MLBAM.
57-Game Hitting Streak Prize
The first eligible participant who accumulates at least a 57-game hitting streak will win ten thousand dollars ($10,000) in cash.
Grand Prize
If no Participant reaches a 57-game hitting streak or greater, the eligible Participant with the longest hitting streak during the Contest Period (the "Grand Prize Winner") will be eligible to win one (1) Grand Prize, described below (the "Grand Prize").
The Grand Prize Winner will receive four (4) tickets to one (1) game the 2005 World Series (Estimated Retail Value of Grand Prize: $1,000). The World Series game and seat locations of such game shall be selected by MLBAM at its sole and absolute discretion. The Grand Prize Winner is fully responsible for any and all applicable federal, state, international and local taxes. Transportation is not included. All costs and expenses not specified herein, related to the Grand Prize, including but not limited to lodging, all transportation costs, meals, taxes (including income taxes) and gratuities, are the sole responsibility of the Grand Prize Winner. MLB World Series game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event a legal game, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbances or any other reason
The MLB Entities will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control, that may cause the cancellation of any 2005 MLB World Series game.
NOTE: Grand Prize will not be awarded if any Participant accumulates at least a 57-game hitting streak, in which case the only 57-Game Hitting Streak Prize will be awarded.
Monthly Prizes
The eligible participant with the longest hitting streak during each month of the 2004 MLB regular season will be eligible to win one (1) $100 gift certificate to the MLB.com Shop.
Additional Prizes
44-Game Hitting Streak (Current National League record)
Any eligible participant who accumulates at least a 44-game hitting streak will win one (1) $100 gift certificate to the MLB.com Shop.
34-Game Hitting Streak (Current MLB Rookie Record)
Any eligible participant who accumulates at least a 34-game hitting streak will win one (1) $50 gift certificate to the MLB.com Shop.
Tiebreaker
In the event of a tie for the Grand Prize or Monthly Prizes, tiebreakers will be used in the following order:
1. Total number of hits during the streak of all the players the participant selected.
2. Total number of hits by the player the participant selected on the most recent day of the streak, going back one day at a time until the tie is broken.
3. Total bases during the streak of all the players the participant selected.
4. Total bases by the player the participant selected on the most recent day of the streak, going back one day at a time until the tie is broken.
5. MLBAM will administer a timed baseball trivia quiz, testing the tied participants' knowledge of Major League Baseball, until the tie is broken.
LEGAL DISCLAIMERS
General Conditions
By playing, each Participant in the Contest accepts and agrees to be bound by these Official Rules, the MLB.com Privacy Policy and Terms of Use, and by the decision(s) of MLBAM which shall be final and binding in all respects. Taxes, if any, are the sole responsibility of the winner of each prize awarded in this Contest. An Internal Revenue Service 1099 form will be issued to winners of prizes with a retail value greater than $600.00. No substitution or transfer of prizes is permitted except by MLBAM.
Each Winner will be notified by e-mail and/or telephone (in MLBAM's discretion) and may (in MLBAM's discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). Each winner may be required to submit a valid social security card and identification to MLBAM and shall be required to execute and have notarized MLBAM's affidavit of eligibility and a liability/publicity release within ten (10) days of receipt. Refusal or return of MLBAM's Affidavit of Eligibility and Release of Liability as non-deliverable will result in disqualification.
Participants agree to allow MLBAM to use their names and likeness in any medium for advertising and publicity purposes, without any compensation (notwithstanding any prize), unless prohibited by law.
All federal, state and local laws and regulations apply. This Contest and these Official Rules will be governed by the laws of the State of New York. Any court of competent jurisdiction sitting within the State of New York, New York County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these Official Rules.
MLBAM is not responsible for lost, late or misdirected entries, for incorrect, inaccurate or incomplete entry information whether caused by a Participant, equipment, or technical malfunction or for any human error, technical error or malfunctions. MLBAM reserves the right to halt the Contest at any time during the Contest Period for any reason.
MLBAM is not responsible for typographical or other human or technical errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the prize winners or the distribution of the prizes.
MLBAM reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.
The MLB Entities, their respective parent companies, trustees, subsidiaries, franchisees, affiliates, licensees, agents, independent contractors and advertising and promotional agencies make no warranties, express or implied, relative to the use or enjoyment of any prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. By entering the Contest, each prize winner agrees to hold harmless and fully release the MLB Entities, their respective parent companies, trustees, subsidiaries, franchisees, affiliates, licensees, agents, independent contractors and advertising and promotional agencies from any and all liability for any injuries, losses, death, or damages of any kind caused by any prize or resulting from the acceptance, possession, quality, use or misuse of the prize, or any portion of any prize.
MLB.com Beat the Streak is a skill contest designed to increase consumer awareness of and interest in Major League Baseball and MLB.com, the Official Site of Major League Baseball. This Contest may not be used for any form of gambling.

Internet
If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of MLBAM which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, MLBAM reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. In such event MLBAM further reserves the right to award the prizes to the players with the most points, as of the termination date.
The MLB Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The MLB Entities are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to Participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.
CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MLBAM RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute as to the identity of a Participant, entries will be declared made by the Authorized Account Holder of the e-mail address submitted at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Any entry that is incomplete, late or otherwise does not comply with these Official Rules will be disqualified. MLBAM reserves the right to halt, modify, or suspend the Contest at any time due to situations beyond the control of the MLB Entities such as work stoppages, acts of God, acts of terrorism, civil disturbances, etc.
In the event that the Contest is challenged by any legal or regulatory authority, MLBAM reserves the right to discontinue or modify the Contest, or to disqualify Participants residing in the affected geographic areas. In such event, the MLB Entities shall have no liability to any Participants who are disqualified due to such an action.
