MLB.com Survivor 2006 Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN

The object of this skill contest is to establish a virtual winning streak and keep it going for as long as possible. You'll do this by selecting one Major League Baseball ("MLB") team every day from a list displayed on MLB.com of all teams that are participating in MLB games on that day. If the team you select for that day wins, your streak continues. If the team you select loses, your streak will end and you will be eliminated from the applicable Contest Period (defined below). You must select a team each game day; however, you can make your team selections for up to seven (7) days in the future. If you fail to select a team for any game day, your streak will end.

Eligibility

MLB.com Survivor 2006 (the "Contest") is open only to legal residents of the fifty (50) United States and Washington D.C. (excluding residents of Louisiana), and Canada (excluding residents of the Province of Quebec) who are legal age of majority in their jurisdictions of residence as of the date of entry. Void outside the fifty (50) United States and Washington D.C., in Louisiana, the Providence of Quebec and where prohibited by law.

Employees or consultants of the MLB Entities (defined below) or any of their respective parents, affiliates, subsidiaries, or advertising and promotion agencies, or the immediate family (parent, sibling, child or spouse) or any person residing in the same household as any such employee or consultant of the above, whether or not related, are not eligible to participate or win a prize. The "MLB Entities" shall mean MLB Advanced Media, L.P. ("MLBAM"), the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions), Baseball Television, Inc. (d/b/a Major League Baseball International), the Major League Baseball Clubs, or any of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, or the directors, officers, employees or agents of the above entities.

How to Register

You may register to participate in the Contest from 12:01 a.m. Eastern Time ("ET") on March 27, 2006 through 11:59 a.m. ET on July 31, 2006 (the "Registration Period"). Limit one (1) registration per unique email address. To register to participate, during the Registration Period visit www.mlb.com and follow the banners, buttons and/or links for the Contest registration page. If you are not already a member of the site, you must become one before you can register to participate in the Contest (membership of the site is free). Please note that all information submitted by entrants is subject to, and will be treated in a manner consistent with, MLB.com's Privacy Policy accessible at: www.mlb.com/mlb/help/mlb_help_about_privacy.jsp.

Contest Schedule

There are eighteen (18) different contest periods (each, a "Contest Period") that you can choose to compete in, as well as a final Contest Period in which the winners of each Contest Period will participate in order to determine the Grand Prize Winner ("Contest Period 19"). Contest Periods are as follows:

Contest Period 1: Begins April 3, 2006 (sign-up begins March 27, 2006)
Contest Period 2: Begins April 10, 2006 (sign-up begins April 3, 2006)
Contest Period 3: Begins April 17, 2006 (sign-up begins April 10, 2006)
Contest Period 4: Begins April 24, 2006 (sign-up begins April 17, 2006)
Contest Period 5: Begins May 1, 2006 (sign-up begins April 24, 2006)
Contest Period 6: Begins May 8, 2006 (sign-up begins May 1, 2006)
Contest Period 7: Begins May 15, 2006 (sign-up begins May 8, 2006)
Contest Period 8: Begins May 22, 2006 (sign-up begins May 15, 2006)
Contest Period 9: Begins May 29, 2006 (sign-up begins May 22, 2006)
Contest Period 10: Begins June 5, 2006 (sign-up begins May 29, 2006)
Contest Period 11: Begins June 12, 2006 (sign-up begins June 5, 2006)
Contest Period 12: Begins June 19, 2006 (sign-up begins June 12, 2006)
Contest Period 13: Begins June 26, 2006 (sign-up begins June 19, 2006)
Contest Period 14: Begins July 3, 2006 (sign-up begins June 26, 2006)
Contest Period 15: Begins July 13, 2006 (sign-up begins July 3, 2006)
Contest Period 16: Begins July 17, 2006 (sign-up begins July 13, 2006)
Contest Period 17: Begins July 24, 2006 (sign-up begins July 17, 2006)
Contest Period 18: Begins July 31, 2006 (sign-up begins July 24, 2006)
Contest Period 19: Begins August 28, 2006 (sign-up begins August 21, 2006) open only to the winners of Contest Period 1 through Contest Period 18)

Each Contest Period continues for a maximum of sixty (60) days unless there is a winner for that Contest Period. You can choose to participate in as many different Contest Periods as you want. Each Contest Period's contest is a separate contest. Your performance in one Contest Period's contest shall have no effect on your performance in any other Contest Period's contest.

Game Administration

By participating, participants agree that MLBAM will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by MLBAM regarding the Contest shall be final and binding in all respects. If you have any questions, please send an e-mail to MLB.com customer support.

Daily Lineup

Selecting Your Team

Each day on which an MLB game is played during any Contest Period, you must select one (1) team from a list displayed on MLB.com. If you fail to select a team for any day of the applicable Contest Period on which a game is played, your streak will end. You may only select one (1) team a maximum of two (2) times during Contest Periods 1-14. Once you have selected a team twice in any Contest Period, you will not be allowed to select that team again during that Contest Period. The list of available teams may change from day to day as a result of scheduling changes, so be alert.

Team Selection Deadline

You will have until five (5) minutes prior to the start of the first MLB game being played on that day to make your team selection for that day. If you fail to pick a team on any day, your streak will end. You can enter each Contest Period beginning seven (7) days before the start of the Contest Period (as noted above) and ending five (5) minutes prior to the start of the first MLB game in the applicable Contest Period, after which time entry into such Contest Period shall be closed. MLBAM's computer shall be the official clock of the Contest.

Doubleheaders

If you select a team playing in a doubleheader, you will be eliminated if that team loses either of its two games on that day. The team must win both games for you to keep your streak alive.

Establishing and Maintaining a Streak

All participants in each Contest Period start at zero. Your streak is measured by how long you survive without picking a losing team. Once you select a team that does not win, your streak ends. If you fail to pick a team on any day, your streak will automatically end and you will be eliminated from that Contest Period. Your streak will remain intact in the event of a cancelled or postponed game.

If all remaining Participants in a Contest Period get eliminated on the same day, they will remain in the game and continue to play until there is one winner for that Contest Period. In the event that a Contest Period lasts for sixty (60) days, all remaining eligible Participants in that Contest Period will be considered a Contest Period Winner and will receive the individual Contest prize as described below.

In the event of a tie for any prize, tiebreakers will be used in the following order:

1. Total number of runs scored by all the teams the participant selected during the streak 2. Total number of hits recorded by all the teams the participant selected during the streak 3. Total number of runs allowed by all the teams the participant selected during the streak (lowest total would win tiebreaker) 4. Total number of hits allowed by all the teams the participant selected during the streak (lowest total would win tiebreaker) 5. MLBAM will administer a timed baseball trivia quiz, testing the tied participants' knowledge of Major League Baseball, until the tie is broken.

Prizes

Prizes are non-transferable and non-assignable, with no cash redemptions or substitutions except by MLBAM who reserves the right to substitute a prize of comparable or greater value at its sole discretion. NO PRIZES WILL BE AWARDED IF NO PARTICIPANT ACHIEVES A WINNING STREAK OF AT LEAST TEN (10) GAMES.

Contest Period Winners:

The last eligible participant remaining in each individual Contest Period (1-18) will be the winner of that Contest Period and will win one (1) $100 gift certificate to the MLB.com Shop (Estimated Retail Value: $100). Gift certificates may be subject to certain terms and conditions. NOTE: Contest Period prizes will only be awarded if an eligible participant achieves a winning streak greater than ten (10) games.

Grand Prize

The eligible winners of each Contest Period will participate in Contest Period 19 to determine the Grand Prize winner of the Contest.

The eligible Grand Prize winner will win four (4) tickets to the 2007 Major League Baseball All-Star Game in San Francisco, CA (the "Grand Prize"). (Estimated Retail Value of Grand Prize: $600). Seat locations at the 2007 MLB All-Star game shall be selected by MLBAM at its sole and absolute discretion. The Grand Prize winner is fully responsible for any and all applicable federal, state, provincial and local taxes. Transportation is not included. All costs and expenses not specified herein related to the acceptance and use of the Grand Prize including, but not limited to, lodging, all transportation costs, meals gratuities and souvenirs, are the sole responsibility of the winner. 2007 MLB All-Star Game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event the 2007 MLB All-Star game is not played due to weather, an act of God, an act of terrorism, civil disturbances or any other reason. Winner agrees to comply with all applicable stadium regulations in connection with the Grand Prize. MLBAM reserves the right remove or to deny entry to winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game.

The MLB Entities and each of their respective parent companies, trustees, subsidiaries, franchisees, affiliates, licensees, agents, independent contractors and advertising and promotional agencies and each of their respective officers, directors, agents and employees (collectively, the "Released Parties") will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control, that may cause the cancellation of the 2007 MLB All-Star game.

Legal Disclaimers

General Conditions

By participating, each participant accepts and agrees to be bound by these Official Rules, the MLB.com Privacy Policy and Website Terms of Use, and by the decision(s) of MLBAM which shall be final and binding in all respects. Taxes, if any, are the sole responsibility of the winner of any prize awarded in this Contest. An Internal Revenue Service 1099 form will be issued to winners of prizes with a retail value greater than $600.00.

Each winner will be notified by e-mail and/or telephone (in MLBAM's discretion) and may (in MLBAM's discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). In the event that the winner does not respond to any such notification within ten (10) days, a disqualification will result and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up. Each winner may be required to submit his/her valid social security card and/or other identification to MLBAM and shall be required to execute and have notarized and return an Affidavit of Eligibility and Release of Liability and, where legal, Publicity within ten (10) days following issuance. Failure to submit any identification required by MLBAM or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of any prize or prize notification as undeliverable may result in disqualification and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up.

Participants agree to allow the MLB Entities and their designees to use their names and likenesses in any and all mediums now or hereafter known for advertising and publicity purposes throughout the world in perpetuity, without any compensation, notification or permission unless prohibited by law.

All applicable federal, state, provincial and local laws and regulations apply. This Contest and these Official Rules will be governed by the laws of the State of New York. Any court of competent jurisdiction sitting within the State of New York, New York County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these Official Rules.

Released Parties are not responsible for lost, late, stolen, garbled, delayed, undelivered or misdirected entries, for incorrect, inaccurate or incomplete entry information whether caused by a participant, equipment, or technical malfunction or for any human error, technical error or malfunctions.

Released Parties are not responsible for any technical, computer, network, typographical, printing, human or other errors relating to or in connection with this Contest, including, without limitation, errors or problems which may occur in connection with the offer or administration of this Contest, the processing of entries, selections or registrations, the tabulation of streaks, the cancellation of games or any errors appearing in any Contest related-materials, including, but not limited to errors in advertising, the Official Rules, the selection and announcement of the Contest prize winners or the distribution of the prizes. MLBAM reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest.

The Released Parties make no warranties, express or implied, relative to the use or enjoyment of any prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. By entering the Contest, participants agree to hold harmless and fully release the Released Parties from any and all liability for any injuries, losses, death, or damages of any kind caused by participation in the Contest or resulting from the acceptance, possession, quality, use or misuse of the Contest Prize, or any portion of any prize, including any travel or activity related hereto.

MLB.com Survivor 2006 is a skill contest designed to increase consumer awareness of and interest in Major League Baseball and MLB.com, the Official Site of Major League Baseball. This Contest may not be used for any form of gambling.

Rules/Winner Information

For winner information (available after December 1, 2006) or an additional copy of the Official Rules, send a self-addressed, stamped envelope to: MLB.com Survivor 2006 c/o Gregg Klayman, MLB Advanced Media, L.P., 75 Ninth Avenue, New York, NY 10011. Specify "Rules" or "Winner List." Requests must be received by September 30, 2007. Residents of VT may omit return postage on rules requests.

Internet

If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, cancellation of games or any other causes beyond the control of MLBAM which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, MLBAM reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. In event of termination, MLBAM further reserves the right to award the prizes to the players with the most points, as determined by MLBAM in its sole discretion, as of the termination date.

The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.

CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE MLB ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute as to the identity of a participant, an entry will be declared made by the Authorized Account Holder of the e-mail address submitted at time of entry. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event that the Contest is challenged by any legal or regulatory authority, MLBAM reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, the MLB Entities shall have no liability to any participants who are disqualified due to such an action.
