Incomplete Entries or Entries that contain inappropriate images, language, nudity or, at the sole discretion of the Sponsor, defamatory, obscene or otherwise inappropriate content will be automatically disqualified. No responsibility is assumed for lost, late, misdirected, damaged, altered, or illegible entries. Materials will not be returned or acknowledged. Contestants can submit multiple unique Nominees. In case of multiple Entries for any Nominee, only the first entry received will be accepted.
Reminder: When you agree to the Official Rules, you are verifying that you have received consent from the Nominee to provide his/her personal information, story and photo.
All information submitted by Contestants is subject to, and will be treated in a manner consistent with, MLB.com's Terms of Use accessible at: http://mlb.mlb.com/mlb/official_info/about_mlb_com/terms_of_use.jsp and Privacy Policy accessible at: www.mlb.com/privacy, and Target's Privacy Policy accessible at: http://www.target.com/spot/privacy-policy. Entries that do not comply with these Official Rules will be void, eliminated and not eligible for consideration.
Contestants will be given the option to receive (a) commercial e-mails from Sponsor, MLB.com and Target (Contestants in the United States only), however, eligibility to participate in the Contest is not dependent upon Contestant's consent to receive such e-mails and updates, and consenting to receive such e-mails and updates will not impact Contestant's chance of winning.
Entries must not contain trademarks, logos or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses; or copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media), except that it is acceptable to include actual trademarks of Major League Baseball and the MLB Clubs.
One winner ("Winner") will be selected for each MLB Club, based on favorite MLB Club designated by each Contestant.
Round 1: Each eligible Entry received during the Contest Entry Period will be judged by Sponsor based on the following equally weighted judging criteria: 1) personal story, 2) passion, 3) presentation, and 4) overall appeal. Up to ninety (90) top scoring Entries, three (3) per MLB Club, will advance to Round 2 of the Contest as potential "Finalists." In the event of a tie, the potential Finalist from among the tied Entries with the highest score for overall appeal will advance to Round 2. In the event of a further tie, the potential Finalist from among the tied Entries with the highest score for presentation will advance to Round 2. In the event of a further tie, Sponsor will re-judge the tied Entries based on overall appeal and, at the Sponsor's sole discretion, select the Entry as a potential Finalist. Sponsor reserves the right to advance fewer than ninety (90) Entries to Round 2 if, in its sole discretion, an insufficient number of eligible and/or qualified Entries are received.
Round 2: After potential Finalists are determined, each potential Finalist will be contacted by the Sponsor and/or its designated agent on or about May 13, 2014. Each Potential Finalist (i.e. Nominee) will be required to execute, notarize and return an Affidavit of Eligibility (or, if a resident of Canada, a Declaration of Eligibility), Grant of Rights & Release of Liability and, unless prohibited by law, a Publicity Release ("Affidavit/Grant/Release") within five (5) days from the date of notification. In addition, at the Sponsor's discretion, each potential Finalist will be subject to a background check, including, but not limited to, education verification, professional verification, employment verification and criminal history. Each Contestant hereby authorizes the MLB Entities and Target, as well as Sponsor, to review his/her Affidavit/Grant/Release and results of his/her background check if he/she is a potential Finalist. To the extent required by law, each potential Finalist shall authorize such background check and Sponsor reserves the right, in Sponsor's sole discretion and in consultation with the MLB Entities and Target, to disqualify any potential Finalist based on the background check. If the Affidavit/Grant/Release is not returned within the time allowed, the potential Finalist will be disqualified and the potential Finalist with the next highest score may be declared the alternate Finalist. Any potential Finalist from Canada will be required to pass a skill testing procedure in the form of an additional essay, explaining in fifty (50) words or less why he/she enjoys being a fan of the MLB Club of his/her choice. Essay will be judged against other such essays based equally on: 1) enthusiasm; 2) presentation; and 3) overall appeal.
Round 2 Public Voting Phase: All Finalist Entries as determined by Sponsor will be posted at www.allstarteachers.com so that the general public can view each Finalist Entry and vote on their favorite Finalist between the period beginning on or about 12:01 AM ET on June 5, 2014 and ending at 11:59 PM ET on June 29, 2014 (the "Voting Period"). Each Finalist Entry may be voted on by the general public, including by each Contestant. A Contestant may vote for his or her own Finalist Photo.
To vote, a person clicks on the voting link within the Voting Gallery as prompted.
Contestants who spam or create false accounts (or otherwise undertake any act intended to manipulate or undermine the integrity of the Public Voting Phase of the Contest) for the purpose of casting votes will have their votes disqualified and their Entries may be voided (if applicable). Public votes may be disqualified by the Sponsor if they are cast from multiple email addresses using the same IP address or have been solicited directly by Contestants from a blog and/or public forum. False or deceptive Entries or acts will also render the Contestant ineligible and Sponsor may disqualify them as the potential winner. Decisions of the Sponsor are final relating to all aspects of the online voting process and results. The Sponsor may disqualify any vote or Entry if Contestant or related parties violate any of the terms and conditions attached to the Contest or these Official Rules.
Round 2 Final Judging Phase: Following the Public Voting Phase, the Finalist Entries will be judged by a panel of judges appointed by People (the "Final Judges"), who shall use the criteria set forth below to determine the Winners. The Finalist Entries will be graded based on the following pre-determined set of criteria:
In the event of a tie, the Finalist (from among the tied Entries) with the highest score for overall appeal will be declared the Winner. In the event of a further tie, Sponsor will re-judge the tied Entries based on overall appeal and, at the Sponsor's sole discretion, select a winning Entry. The Winners will be announced on or about July 10, 2014.
For the avoidance of doubt, those Finalists who are not selected Winners will not receive any prize or compensation of any kind.
Prize and its Approximate Retail Value ("ARV"): (30) Prizes (one for each MLB Club): A 4-day/3-night trip for Winner and one (1) guest to the Major League Baseball® All-Star Game® on July 15, 2014 in Minneapolis, Minnesota as well as a VIP experience including the All-Star Brunch and Gala (collectively, the "Prize"). Guest must execute and return to Sponsor a Release of Liability and, unless prohibited by law, Publicity within five (5) days of Winner notification. Other restrictions may apply. ARV: $4000. The actual retail value of the prize will depend on Winner's point of departure/return and dates of travel. If actual value of prize turns out to be less than stated ARV, the difference will not be awarded in cash. Prize consists of only those items specifically listed as part of the prize. In addition, the Winner may, at the sole discretion of the Sponsor, be featured on People.com and/or in PEOPLE Magazine. Prize is nontransferable.
Seat locations shall be selected by the applicable MLB Entity at its sole and absolute discretion. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and may be subject to change. Each Winner and his/her guest(s) agree to comply with all applicable stadium regulations in connection with the Prize. Sponsor and the applicable MLB Entities reserve the right to remove or to deny entry to any Winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. The MLB Entities will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, epidemic, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition. Major League Baseball game, event and exhibition tickets awarded as prizes may not be sold or offered for sale. Any such sale may result in disqualification and Prize forfeiture, and may invalidate the license granted by the game, event or exhibition ticket(s).
Winners will be notified on or about July 4, 2014. If Winner cannot be reached by telephone and/or email within five (5) days of date of issuance, Winner will be disqualified and the Finalist with the next highest number of votes will be declared the alternate Winner. At discretion of the Sponsor, Winner may be asked to travel or promote future contests, advertising, media parties, in-store promotions and/or other promotional events without additional compensation (except where prohibited by law) as set forth in the Affidavit/Grant/Release for a period of one year. However, if needed, the Sponsor will pay travel and hotel/lodging accommodations for these promotional appearances and events. In the event Winner cannot accept the Prize for any reason whatsoever, he/she will automatically be disqualified and an alternate Winner may be determined from among all remaining eligible Entries. Each Winner, by acceptance of the Prize grants to Sponsor, the MLB Entities, Target and each of their respective designees the right to publicize such Winner's name, address (city and state/province of residence), voice, biography, photographic and artistic likeness, voice, statements, and/or other likeness and prize information for advertising, promotional, trade publicity and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without additional compensation, consideration, permission or notification, unless prohibited by law.
By entering this Contest and submitting an Entry, including the photograph, each Contestant and Nominee grants to Sponsor, MLBAM, the other MLB Entities, Target and/or each of their respective agents and designees, as applicable, the right to print, copy, publish, use, edit, exhibit, distribute, perform, merchandize, license, sublicense, adapt and/or modify any Entry in any way in any and all media whether now known or hereafter developed, without limitation and without compensation or consideration, notification or permission, to the Contestant or any third parties. Submission of an Entry further constitutes the Contestant's consent to irrevocably assign and transfer to Sponsor, MLBAM, the other MLB Entities and/or Target, as applicable, any and all rights, title and interest in and to all elements of the Entry, including, without limitation, all copyrights, without additional compensation or consideration, notification or permission, to the Contestant or any third parties. Furthermore, by entering the Contest and submitting an Entry, Contestant represents that he/she has or can obtain all necessary rights, and hereby grants the Sponsor, MLBAM, the other MLB Entities, Target and each of their affiliated companies and divisions, as applicable, publication and use rights as described herein. In addition, if an Entry is selected for web posting/voting by the Sponsor, MLBAM, the other MLB Entities, Target Brands, Inc. or any their respective agents, as applicable, the Contestant hereby certifies that no other person or entity holds rights to the Entry, including photograph. Entries will not be acknowledged and will not be received or held "in confidence" and an Entry does not create a confidential relationship or obligation of secrecy between Contestant and the Sponsor, the MLB Entities, Target and/or any of their respective affiliates, as applicable.
At the Sponsor's discretion, Winner may need to provide a written statement to Sponsor that he/she has not had prior professional modeling experience (e.g., someone who has never received any compensation for appearing in a national print or television advertisement and/or a publication with a circulation of 100,000 (or higher) and is not a member of SAG, AFTRA or Equity). Furthermore, the Sponsor reserves the right to disqualify any Contestant for (i) failing to execute any required paperwork, refusing to participate in any promotional event or advertising for this Contest, or (ii) engaging in any activity which offends the public morals or denigrates, disparages, reflects negatively or embarrasses the Sponsor, any of the MLB Entities or Target as determined in their sole discretion, (iii) violating the laws, rules or regulations of any jurisdiction, and/or (iv) altering his/her appearance in any way whatsoever without the prior consent of the Sponsor.
By entering this Contest, each Contestant releases and holds harmless Sponsor, the MLB Entities, Target and each of their respective parent companies, subsidiaries, affiliates, directors, officers, employees, licensees, sponsors, agents and advertising and promotional agencies from any and all liabilities or any claims, injuries, demands, losses or damages of any kind arising from or in connection with (a) this Contest, (b) the use or misuse of any prize (including any travel or prize activity related thereto); and/or (c) the Entry (including any photograph submitted therewith) and the use thereof as permitted hereunder, including, but not limited to, claims of false endorsement or infringement of rights of publicity or privacy.
