2016 MLBAM Bases Coded Technology Challenge Presented by New Relic Official Rules (the "Official Rules")


The object of the 2016 MLBAM Bases Coded Technology Challenge presented by New Relic (the "Competition") is to submit an original online application demonstrating what you would want to build using given data sources listed on the application page, and an efficient solution to a proposed challenge listed on the application page (“Application”). For those selected as Participants, the object of the Competition is to submit an original baseball-themed consumer product to be developed using certain data and other materials provided by MLBAM (the “Submission”). A panel of judges that will include staff members of MLB Advanced Media, L.P. (“MLBAM”) and, New Relic, Inc. (“New Relic”) and one (1) or more industry expert(s) (who may also be employees of one (1) or both of the foregoing entities) (collectively referred to herein as the “Judges”) will select the most compelling Applications and Submissions based upon judging criteria set forth herein.


The Competition is open only to legal residents of the fifty (50) United States and Washington, D.C. who (a) are eighteen (18) years of age or older (except in the case of legal residents of certain states where the legal age of majority is greater than eighteen (18) years of age, such legal age of majority) at the time of entry; and (b) join a team of at least two (2) and up to three (3) eligible participants (each, a “Team”). No other person(s) are eligible. No employees, spouses or family members of MLB Advanced Media, L.P., the other MLB Entities, any of their sponsors or New Relic are eligible to participate. The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLBAM, Major League Baseball Properties, Inc., BAMTech, LLC, The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. The Competition is subject to all applicable federal, state and local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation.

2) COMPETITION SUBMISSION PERIOD: The application period begins at 12:00:01 p.m. Eastern Time (“ET”) on Thursday September 22, 2016 and ends at 11:59:59 p.m. ET on Friday, October 7, 2016 (hereafter, “Application Period”).

3) FINAL JUDGING EVENT: The final judging event will begin on 10/28/16 at a time to be determined by the Judges (“Start Time”) and end on 10/29/16 at exactly twenty-four (24) hours after the Start Time (as monitored and enforced by Sponsor in its sole discretion) and will take place at a location in the National League Champions home town during the World Series (“Final Judging Event Location”) to be determined by MLBAM (hereafter, the “Final Judging Event”). Time zone will be determined by location of Final Judging Event.


To apply during the Application Period, Teams must do all of the following: (a) visit www.basescoded.com or www.mlb.com/basescoded to access the Application for the Competition; (b) read and consent to the Consent, Assignment and Release (as defined below), the License to MLBAM Proprietary Rights (as defined below) and these Official Rules; and (c) follow the instructions provided to complete and submit the Application inclusive of a proposal for a baseball-themed consumer product app (“Submission”) (altogether the “Application Process”). All Applications must include a valid e-mail address for the Team. All information submitted online is subject to, and will be treated in a manner consistent with, MLB.com’s Terms of Use accessible at: http://mlb.mlb.com/mlb/official_info/about_mlb_com/terms_of_use.jsp and Privacy Policy accessible at: www.mlb.com/privacy. Teams must fully complete and submit all non-optional data requested on the Application. Incomplete Applications are void. Successful completion of the Application Process will classify each Team as a “Participant Team.”


Each Submission must use New Relic products/ services (as provided for use) to assist with the development of the application. Submission must be a fully executable program submitted to an assigned private code repository in conjunction with an assigned private Amazon Web Services instance provided by MLBAM (“AWS Account”). Upload should contain all files and assets used on the Submission and represent the fully functional code of the final product (the “Submission Requirements”). Additional technical instructions and requirements will be provided to the Finalists during the Final Judging Event. Finalists will be granted access to an AWS Account during the Final Judging Event only and must (a) use the AWS Account in good faith, in compliance with all applicable laws/rules/regulations and solely for purposes of, and as necessary to participate in, this Competition; and (b) not exceed $5,000 in AWS Account costs. Submissions that do not comply with the Submission Requirements, the Content Restrictions (as defined below) or otherwise with these Official Rules will be void, eliminated and not eligible for consideration. Limit one (1) Submission per Participant Team. Additional entries beyond the specified limit will be void. Participants are solely responsible for Internet connectivity, software and/or hardware that may be required in order to create and/or submit any Submission.


The Judges will judge all eligible Submissions based on the following judging criteria: Strength of Potential Idea (evaluation of the quality and uniqueness of the approach to the subject matter) (60%), and Efficiency of Coding Demonstration (evaluation of efficiency of solution to the proposed challenges) (40%) (“Round 1 Judging Criteria”). Subject to verification of eligibility and compliance with these Official Rules, the five (5) eligible Participant Teams that submitted the five (5) highest scoring Submissions will be named potential finalist teams. Subject to verification of eligibility and compliance with these Official Rules, the potential finalist teams will be declared the official “Finalist Teams” and will be required to attend the Finalist Judging Event in order to advance in the Competition.

All potential Finalist Teams will be notified via e-mail on or about Monday, October 17, 2016. In the event that any potential Finalist does not respond to such notification within twenty-four (24) hours of the time of issuance or declines to participate in the Final Judging Event for any reason, a disqualification will result and, at MLBAM's sole discretion and time permitting, an alternate potential finalist may be selected based on the scores in the Round 1 Judging Criteria. All eligible Finalists must be able to attend the Final Judging Event in person and must be suitable for presentation in a public forum. In the event any Finalist is not able to attend the Final Judging Event, such Finalist will be disqualified and will no longer be eligible to receive any prize.


During the Final Judging Event, the Finalist Teams will follow instructions provided to further develop and present their Submissions (hereafter, “Finalist Submissions”). The Judges will judge the Finalist Submissions based on the following judging criteria (“Round 2 Judging Criteria”):

The Finalist Team with the highest score will be declared the Winning Submission”. Subject to verification of eligibility and compliance with the terms of these Official Rules, each eligible member of the Team that submitted the Winning Submission, as determined by the Judges, will be declared the official winners of the Grand Prize (defined below) (the "Grand Prize Winners"). The remaining four (4) Finalist Teams will be declared the first prize winners (the "First Prize Winners" together with the Grand Prize Winners, the “Winners”) and receive a First Prize (defined below). In the event of a tie for any potential winning Submission, the score for Performance will be used as the tiebreaker.


Up to three (3) Grand Prizes: Each Grand Prize Winner will receive (a) one (1) ticket for game four (4) of the 2016 MLB World Series; (b) one (1) ticket to New Relic’s annual user conference {Future}Stack16 in San Francisco, CA for each of the following dates: November 16-17, 2016; and (c) four (4) night hotel accommodation (one (1) standard double occupancy room) in Final Judging Event Location at a hotel determined by MLBAM at its sole discretion; (the “Grand Prize”); provided, however, that (i) each such Grand Prize Winner must fully comply with and satisfy all requirements set forth in these Official Rules, including those set forth in the Notification section below Each Grand Prize Winner, at his/her sole cost and expense, is solely responsible for securing all transportation, lodging and housing costs, beyond the four (4) night hotel accommodations, associated with the Grand Prize and not provided for herein. Grand Prize will be subject to each Grand Prize Winner’s agreement to separate rules and requirements determined in the sole and absolute discretion of MLBAM. For the avoidance of doubt, MLBAM shall be under no obligation to publish, sell or otherwise make the Submission available commercially. Approximate retail value (“ARV”) of each Grand Prize: $1,700.00

Up to twelve (12) First Prizes: Each First Prize Winner will receive (a) one (1) One Hundred Dollar ($100) Mastercard gift card, subject to the terms and conditions of issuer; (b) four (4) night hotel accommodation (one (1) standard double occupancy room) in Final Judging Event Location at a hotel determined by MLBAM at its sole discretion; and (c) one (1) prize package consisting of merchandise item(s) selected in MLBAM’s sole discretion (the “First Prize”) ARV of each First Prize: $1,400.00. TRANSPORTATION AND LODGING BEYOND THE FOUR (4) NIGHT HOTEL ACCOMMODATION IS NOT INCLUDED IN ANY FINALISTS PRIZE.

Up to fifteen (15) Finalist Prizes: Each Finalist Team member will receive a trip to the Final Judging Event (the “Finalist Prize”). Trip includes round-trip, coach air transportation between the Final Judging Event Location and a major airport nearest such Finalist Team member’s residence. ARV of each Finalist Prize: $1,000.00. Trip must be taken on dates specified by MLBAM or travel will be forfeited. Travel restrictions apply. Travel arrangements must be made through MLBAM’s agent and on a carrier of MLBAM’s choice.

Maximum ARV of all Prizes: $36,900.00.


In the event any winner resides more than one hundred fifty (150) miles from the Prize destination, as determined by MLBAM at its sole discretion, MLBAM will provide such winner with round-trip, coach air transportation between the Prize destination and a major airport nearest such winner’s residence. All Prize details shall be determined in the sole and absolute discretion of the MLBAM. The Prizes are non-transferable and non-assignable, with no cash redemptions except at MLBAM’s sole and absolute discretion. MLBAM reserves the right to substitute any Prize (or any portion thereof) with a prize of comparable or greater value at its sole and absolute discretion. The Winners are fully responsible for any and all applicable federal, state and local taxes (including income and withholding taxes). All costs and expenses associated with Prize acceptance and use not specified herein as being provided, including but not limited to lodging beyond what is provided for above, transportation costs, meals, gratuities and other expenses incurred by accepting the Prize are the sole responsibility of each individual Winner. Seat locations at the games, event or exhibitions shall be determined in the sole discretion of MLBAM. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the applicable Major League Baseball Club, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as part of the Grand Prize will govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played or held, as applicable, due to weather conditions, an act of God, an act of terrorism, civil disturbance or any other reason. Each Winner agrees to comply with all applicable ballpark and venue, as applicable, regulations in connection with the applicable Prize. MLBAM and the applicable other MLB Entities reserve the right to remove or to deny entry to any Winner who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Released Parties (defined below) will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition. Major League Baseball game, event and exhibition tickets awarded as prizes may not be resold or offered for resale or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and Grand Prize forfeiture, and may invalidate the license granted by the game, event or exhibition ticket(s).


MLBAM will be responsible for resolving any disputes and rules violations that arise in connection with the Competition. MLBAM’s computer will be the official clock of the Competition. All decisions by MLBAM regarding the Competition shall be final and binding in all respects.


All participants must execute the Consent, Assignment and Release provided in connection with completion of the Application to be eligible, which Consent, Assignment and Release is hereby incorporated into these Official Rules.


New Relic’s products and services may be used during the Competition to monitor performance metrics of the Finalists’ Submissions. Any use of New Relic’s products are subject to New Relic’s Terms of Service found at: https://newrelic.com/terms.


All participants must execute the License to MLBAM Proprietary Rights provided in connection with completion of the Application to be eligible, which License to MLBAM Proprietary Rights is hereby incorporated into these Official Rules.


Participants must not include any of the following content (the “Content Restrictions”) in any Application or Submission: (i) pornography, adult-oriented content or any other sexually-explicit material; (ii) materials relating to lotteries or gambling; (iii) explicit language or content, images of violence or promotion of illegal activities; (iv) content in violation of intellectual property rights or laws; (v) libelous, defamatory, disparaging, tortious or slanderous materials; (vi) content that denigrates, disparages or reflects negatively on the MLB entities, their owners and employees, or the game of baseball; (vii) tobacco, alcohol or drugs; (viii) dangerous stunts; (ix) real weapons of any kind including, but not limited to, guns, knives or projectiles; (x) material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by federal, state, or local law, ordinance, or regulation; (xi) individuals under legal age of majority without providing a signed release from parent or legal guardian; (xii) audio and/or visual content owned by any third party (e.g., recorded music; pre-produced video, etc.); and (xiii) material that is unlawful, or otherwise in violation of or contrary to the laws or regulations in any state where the Submission is created. Any Submission that does not comply with the foregoing, in the sole discretion of MLBAM, will be disqualified and eliminated from consideration.

Each potential Prize winner will be notified in person, by email and/or telephone by MLBAM and may (in MLBAM’s discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). In the event that any potential winner does not respond to such Prize Notification within twenty-four (24) hours of the time of issuance or declines the Prize for any reason, a disqualification will result and the Prize will be forfeited. Each potential Prize winner may be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability, and, unless prohibited by law, Publicity, within five (5) days of the date of issuance. In addition, each potential Grand Prize winner will be required to submit his/her valid social security number and/or other identification to MLBAM, within five (5) days of the date of issuance of Prize Notification. Failure to submit any identification required by MLBAM or to return any required documentation within any time period specified by MLBAM, the return of such documents, the Prize (or any portion thereof) or Prize Notification as undeliverable, or noncompliance with these Official Rules may result in disqualification and Prize forfeiture.


By participating in the Competition, each Participant (a) accepts and agrees to be bound by these Official Rules, including all eligibility requirements, the MLB.com Privacy Policy and MLB.com Terms of Use; and (b) gives his/her express permission to be contacted by MLBAM and/or its representatives for Competition administration purposes.

All applicable federal, state, provincial and local laws and regulations apply. MLBAM’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

MLBAM, the other MLB Entities, New Relic and each of their respective parent companies, trustees, subsidiaries, franchisees, assignees, affiliates, licensees, agents, independent contractors, telecasters, sponsors, licensees, advertising and promotional agencies, and each of their respective general and limited partners, members, shareholders, officers, directors, agents, employees, representatives and contractors (collectively, the “Released Parties”) shall not be responsible for lost, late, stolen, garbled, delayed, undelivered, or misdirected entries, for incorrect, inaccurate or incomplete entry information whether caused by a Participant, equipment, or technical malfunction or for any human error, technical error or malfunctions.

Released Parties are not responsible for any technical, computer, network, typographical, printing, human or other errors relating to or in connection with this Competition, including, without limitation, errors or problems which may occur in connection with the offer or administration of this Competition, the processing of entries or registrations, the tabulation of scores, the cancellation of games or any errors appearing in any Competition related-materials including, but not limited, to errors in advertising, the Official Rules, the selection and announcement of Winners or the distribution of the Prizes. MLBAM reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Competition.

Released Parties make no warranties, express or implied, relative to the use or enjoyment of any Prize or portions thereof, including without limitation, its quality, merchantability or fitness for a particular purpose. By entering the Competition, each Participant agrees to indemnify and hold harmless and fully release the Released Parties from any and all claims, demands, losses, promise, causes of action and/or liabilities for any injuries, losses, death, or damages of any kind caused, directly or indirectly, in whole or in part, by participation in, or preparation for, the Competition, Competition-related activity, Participant’s Submission, or resulting from the acceptance, possession, quality, use or misuse of any Prize, or any portion of any Prize, including any travel or activity related thereto.

The Competition is a skill Competition. This Competition may not be used for, or in connection with, any form of gambling.


Participants warrant that any materials submitted in this Competition/Application process are their own original work and, as such, they are the sole and exclusive owner and rights holder of the submitted materials and that they have the right to submit the materials in the Competition and grant all required licenses. Each entrant agrees not to submit any materials that (1) infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, privacy, publicity or confidentiality obligations; or (2) otherwise violates the applicable state, federal, local or provincial law. To the maximum extent permitted by law, each entrant indemnifies and agrees to keep indemnified Competition Entities at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the entrant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each entrant agrees to defend, indemnify and hold harmless the Competition Entities from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorney’s fees) arising out of or accruing from (a) any Submission or solution or other material uploaded or otherwise provided by the entrant that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy, (b) any misrepresentation made by the entrant in connection with the Competition; (c) any non-compliance by the entrant with these Rules; (d) claims brought by persons or entities other than the parties to these Rules arising from or related to the entrant’s involvement with the Competition; (e) acceptance, possession, misuse or use of any prize or participation in any Competition-related activity or participation in this Competition; (f) any malfunction or other problem with the Competition Site; (g) any error in the collection, processing, or retention of entry information; or (h) any typographical or other error in the printing, offering or announcement of any prize or winners.

If the Competition is not capable of running as planned for any reason, including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Competition, MLBAM reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Competition and, if terminated, to determine the Winners, if any, from among all eligible, non-suspect Submissions submitted up to the point of termination.

Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network, cable, satellite, wireless, Internet Service Provider (ISP) or lines, computer systems, servers, or providers, computer equipment, software, malfunctions of wireless devices, wireless service problems, cellular tower equipment, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website or wireless service congestion, or any combination thereof, including any injury or damage to Participant's or any other person's computer related to or resulting from participation or downloading any materials in this Competition.


In the event of dispute as to the identity or eligibility of any potential winner based on an e-mail address, the winning entry will be declared made by the Authorized Account Holder of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. The “Authorized Account Holder” is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address for the domain associated with the submitted e-mail address.

In the event that the Competition is challenged by any legal or regulatory authority, MLBAM reserves the right to discontinue or modify the Competition, or to disqualify Participants residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any Participants who are disqualified due to such an action.

As a condition of entering this Competition, each entrant agrees that (a) any and all disputes, claims, controversies or causes of action arising out of or relating to this Competition, or any prizes awarded (each, a "Claim"), shall be (i) arbitrated on an individual basis only, and shall not be consolidated or joined with or in any arbitration or other proceeding involving a Claim of any other party, and (ii) settled by binding arbitration in New York County, New York before a single arbitrator appointed by the American Arbitration Association in accordance with its then governing rules and procedures, and judgment on the award rendered by the arbitrator may be entered by any court having jurisdiction thereof; and (b) under no circumstance will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for actual out-of-pocket expenses. These Official Rules shall be governed by and construed and interpreted in accordance with the laws of the State of New York, U.S.A, applicable to contracts entered into and performed exclusively in that State.
