ELIGIBILITY: The MLB.com Twitter Hunt Promotion Brought to You By Don Julio (“Promotion”) is open to legal residents of the United States and the District of Columbia (excluding the states of CA & RI) who are 21 years of age or older as of 7/9/12. Promotion is void in CA, RI and where prohibited or restricted by law. Only entrants that are located within Kansas City, MO area as of 7/9/12 and 7/10/12 are eligible to participate. Employees, officers and directors of MLB Advanced Media, L.P. (“MLBAM,” or “MLB.com” or “Sponsor”), the other MLB Entities (as defined below), Diageo, Project Support Team, Inc. ("Administrator"), Twitter, and each of their respective parent companies, subsidiaries, affiliates, governors, related entities, partners, partnerships, principals, licensees, sponsors, and advertising/promotion agencies and all of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, "Released Parties"), and the immediate family members (parent, spouse, sibling, or child, and their respective spouses, regardless of where they reside) and those living in the same household (whether or not related) of each such employee, officer or director are not eligible to participate or win. The "MLB Entities" shall mean MLBAM, the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, SportsOnEarth, LLC, Tickets.com, Inc., MLB Advanced Media DH, LLC, Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, The MLB Network, LLC and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities. This Promotion is subject to all applicable federal, state, and local laws. Twitter is neither a Sponsor of nor affiliated with this Promotion. By entering, you understand that you are providing your information to the Sponsor and not to Twitter. The information you provide as detailed below will only be used as set forth in these Official Rules.
PROMOTION PERIOD: The Promotion starts at 8:00:01 AM Central Time (“CT”) on 7/9/12 and will end when all prizes have been claimed no later than 7/10/12 6:00:01 PM CT (the “Promotion Period”)
HOW TO PARTICIPATE/WINNER DETERMINATION: To enter this Promotion, you must have a Twitter account. If you do not have a Twitter account you may sign-up for free by visiting www.twitter.com & following the enrollment instructions. To participate: 1) Visit www.twitter.com/mlb or, from your Twitter home page, click on the "Find People" tab & perform a search for "MLB"; 2) Click on the "Follow" button corresponding to the official @MLB channel; 3) Throughout the Promotion Period, @MLB will Tweet clues to locate the prize (“winning destination”). A minimum of three (3) clues will be ‘tweeted’ for the winning destination; 4) Follow the clues to the destination designated. The first eligible contestant to reach each respective destination and correctly repeat the Twitter phrase “Know Your All-Stars” at the destination to the authorized Sponsor representative will be deemed the winner of the Promotion. In the event a prize is claimed before all the clues are given, contestants will be notified via a ‘tweet’ that the respective Prize has been located. Winners will be notified on-site. Winner must be present at the winning destination and correctly repeat the Twitter phrase found indicated above to the authorized Sponsor representative to win a prize. In the event that more than one person reaches the winning destination at the same time and simultaneously repeats the correct Twitter phrase to the authorized Sponsor representative, each Participant will be asked to answer, without assistance of any kind, a question selected by Sponsor based on knowledge of the MLB and All-Star Game with a time limit of five (5) seconds. The Participant that answers the question correctly, within the designated time limit, will be declared a Prize Winner (based on the prize at issue). In the event multiple Participants answer the question correctly, another question will be asked and this process will be repeated until only one of the Participants answers the question posed correctly. Once a question has been answered incorrectly, the Participant will not be able to answer again on that question. If all tied Participants answer the question incorrectly, another question will be asked and the above process will be repeated until only one of the Participants answers the question posed correctly. A question that is not answered in the permitted time period will be considered answered incorrectly. Potential prize winners may be required on-site to complete a prize acceptance form. Non-compliance with any of the foregoing or these Official Rules may result in disqualification and, time permitting, awarding of prize to an alternate potential winner, at Sponsor’s sole discretion. Limit one (1) prize per person, per household and per e-mail address, per entry period.
PRIZES: One (1) Home Run Derby Tickets Prize: Two (2) tickets to the 2012 MLB Home Run Derby. Approximate Retail Value (“ARV’): $250. Two (2) All-Star Ticket Prizes/(1) to awarded on 7/9/12 and (1) to be awarded on 7/10/12): Two (2) tickets to the 2012 MLB All-Star Game. ARV: $500. Two (2) All-Star Fan Fest Ticket Prizes/(1) to awarded on 7/9/12 and (1) to be awarded on 7/10/12): Two (2) tickets to 2012 MLB All-Star Fan Fest and meet and greet with MLB.com talent on set. ARV=$200. Total ARV of all prizes: $1,650. TRANSPORTATION TO/FROM GAME AND LODGING ARE NOT INCLUDED AND ARE THE SOLE RESPONSIBILITY OF THE PRIZE WINNERS. Winners are solely responsible for all income, federal, state and local taxes as well any other costs or expenses associated with prize acceptance and use not specified herein as being provided, including, but not limited to, ground transportation and souvenirs. Game tickets are subject to availability and must be used on the dates specified by MLBAM (except for rain-outs) or prize will be forfeited and MLBAM will have no further obligation to such winner. Location of seats will be determined by MLBAM in its sole and absolute discretion. Major League Baseball game dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and may be subject to change. The terms and conditions of the tickets awarded will govern in the event a legal game or event, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Each ticket Prize winner and his/her guest agree to comply with all applicable Major League Baseball and Major League Baseball Club stadium rules and regulations relating to the use of Major League Baseball game tickets and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at such game. The applicable MLB Entities reserve the right to remove or to deny entry to any winner and/or any of his/her guest who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game or event. Released Parties will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game or event. Major League Baseball event and exhibition tickets awarded as prizes may not be resold or offered for resale. Any such resale may result in disqualification and forfeiture of prize, and may invalidate the license granted by the game ticket(s). All prize details are at MLBAM’s sole discretion.
Miscellaneous: No transfer, assignment, cash redemption, or substitution of prize (or portion thereof) permitted except by MLBAM and/or Administrator, as applicable, who may substitute a prize (or portion thereof) with a prize of comparable or greater value at their sole and absolute discretion. By participating, each entrant agrees (1) to be bound by these Official Rules, (2) that Sponsor and each of its designees shall have the right and permission to use (unless prohibited by law) entrant’s name, voice, address (city and state of residence), photograph and/or other likeness for advertising, promotional and/or trade and/or any other purpose in any and all media or format now known or hereafter devised throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification to entrants or any third parties; and (3) that the Released Parties and each of their respective employees, agents, representatives, licensors, successors and assigns shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any prize (including any travel or activity related thereto) and/or participation in this Promotion. Sponsor reserves the right, in its sole discretion, to modify, terminate or suspend this Promotion (or any portion thereof) should viruses, bugs, unauthorized human intervention or other causes corrupt or impair the administration, security, fairness or proper operation of the Promotion (or any portion thereof) and, in the event of termination, at its discretion, to randomly select a winner from those eligible, non-suspect entries received prior to event requiring such termination. Administrator and/or MLBAM, as applicable, reserve the right, in their sole discretion, to disqualify any person and void all associated entries of any person who they believe has tampered with, or attempted to tamper with or impair, the entry process, or any other component of this Promotion, whose conduct or actions affect or impair the administration, integrity, security, fairness or proper conduct of this Promotion, or who is in violation of these Official Rules.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION IN ANY WAY, OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROMOTION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR, MLBAM AND/OR THEIR RESPECTIVE AGENTS WILL DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND/OR OTHER REMEDIES FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMISSIBLE BY LAW.
Arbitration: Except where prohibited by law, as a condition of participating in this Promotion, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held in New York County, New York; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.
Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
