2012 FAN APPRECIATION DAY
OFFICIAL SWEEPSTAKES RULES
NO PURCHASE NECESSARY TO ENTER OR TO WIN. The Fan Appreciation Day Sweepstakes (the "Sweepstakes") is void where prohibited by law, taxed, or required to be licensed. The "Entry Period" for the Sweepstakes begins on September 17, 2012 and ends on September 30, 2012. The Sweepstakes is sponsored by Los Angeles Dodgers LLC (the "Dodgers"). If, in the Dodgers' exclusive judgment, this Sweepstakes becomes compromised in any way, the Dodgers reserve the right to withdraw the offer, to void any entries submitted fraudulently, or to select the winners from all eligible entries received prior to the act that compromised the Sweepstakes. The odds of winning will depend on the number of eligible entries received.
TO ENTER: There are two (2) methods by which persons desiring to submit an entry may enter the Sweepstakes: the "Dodger Stadium Automatic On-Site Method" and the "Dodger Stadium Entry Form Method."
Only day-of-game tickets and official entry forms will be accepted as entries to the Sweepstakes. No reproductions, mechanical or otherwise, of tickets or official entry forms will be accepted. One (1) ticket or one (1) official entry form per person is permitted. Entrants assume all risk of loss, damage, destruction, delay, or misdirection of Sweepstakes materials, whether such materials are submitted by the entrant or sent to the entrant by the Dodgers. The Dodgers will not be responsible for any lost, damaged, incomplete, misdirected, illegible, or late entries. All submissions become the property of the Dodgers and will not be returned. The Dodgers will not acknowledge receipt of entries.
THE PRIZE: The "Prizes" specified in the Fan Appreciation Day Prize List attached hereto as Attachment A and incorporated herein by this reference, shall be given away in a series of drawings to be conducted by the Dodgers during the Game. No substitutions, including cash substitutions, of any Prizes by winners will be allowed. The Dodgers reserve the right to substitute any Prize with a prize of similar value and/or quality. The Dodgers further reserve the right to add additional prizes pursuant to the provisions of Section 6, below. All Prizes will be awarded "as is" with no warranty or guarantee, either express or implied by the Dodgers. Each Prize is nontransferable. All federal, state, and local taxes apply. Each Prize winner shall be solely responsible for reporting and paying any and all taxes associated with his or her Prize.
ELIGIBILITY: Subject to the additional restrictions in Section 5, below, entrants in the Sweepstakes must be legal residents of the United States or its territories in order to enter the Sweepstakes. Employees of the Dodgers, and their affiliates, contractors, subsidiaries, distributors, sales representatives, retailers, advertising or promotion agencies, and any individuals engaged in the development, production, or distribution of Sweepstakes materials, and the immediate families and household members of any of the above, are not eligible to enter the Sweepstakes.
THE GROUNDS CREW DAY PRIZE: In addition to any and all eligibility requirements contained herein, the winner of the Grounds Crew Day Prize (as defined in Attachment A) must reside within a 70-mile radius of Dodger Stadium, 1000 Elysian Park Avenue, Los Angeles, California 90012. Failure to reside within the aforementioned 70-mile radius of Dodger Stadium will result in such entry being reentered in the pool of eligible entries for future drawings, if any, and the random selection of a substitute winner from among all remaining eligible entries.
THE DRAWING: During the Game, the winning entries will be selected in a series of computerized random drawings conducted by the Dodgers from among all eligible entries received by the Dodgers by no later than the commencement of the first inning of the Game. Once a winning entry is drawn, it will not be returned to the pool of eligible entries for future drawings, if any. The holder of a winning entry will be deemed the winner of the Prize for the respective drawing. If a Prize is won by a minor, the Prize will be awarded in the name of the minor's parent or legal guardian, who shall be required to execute all required documents on behalf of the minor. Each winning entry will be announced by the Dodgers during the Game, and by any other means that the Dodgers, in their sole discretion, deem appropriate. The Dodgers shall not be responsible for a Prize winner's failure to receive the notice that his or her entry has been drawn. If a winner is ineligible to receive his or her Prize for any reason, such winner's Prize will be forfeited and another winning entry will be drawn by the Dodgers.
CONDITIONS OF PARTICIPATION: By participating in the Sweepstakes, each entrant accepts and agrees to be bound by all of the terms and conditions set forth in these official rules ("Rules") and any decisions made by the Dodgers, in accordance with or pursuant to these Rules, which decisions shall be final and legally binding on all matters relating to this Sweepstakes.
Further, by participating in the Sweepstakes, each entrant agrees, to the fullest extent permitted by law, to indemnify, release, forever discharge, and hold harmless, and covenant not to sue, the Dodgers, and their owners, stockholders, members, directors, officers, employees, agents, representatives, affiliated entities, successors, heirs, and assigns, and each and every person acting by, through, under or in concert with them, or any of them (hereinafter referred to as the "Indemnified Parties") of and from all manner of action or actions, cause or causes of action, at law or in equity, suits, claims, demands, damages, liability, lost cost or expense, of any nature whatsoever, known or unknown, fixed or contingent which the entrant may have or hereafter have against the Indemnified Parties by reason of any damages, loss, or injuries sustained by the entrant, whether to his or her person and/or property, as a result of or incident to the negligent acts or omissions of the Indemnified Parties in conducting the Sweepstakes and/or of entrant's participation in the Sweepstakes.
Each Prize winner will be required to sign and return an Affidavit of Eligibility and Release at the time the Prize is awarded, or his or her Prize will be forfeited. By accepting a Prize, each winner agrees that the Dodgers shall have the right, where permitted by law, to use the winner's name, voice, and likeness, and any photographs, films, or recordings made of the winner, in any manner whatsoever, at the Dodgers' sole discretion, worldwide, in perpetuity, including, without limitation, for advertising or promotional purposes, without having to pay any compensation to the winner for any such use.
As a condition of entering this Sweepstakes, each entrant agrees that: (1) under no circumstances will the entrant be entitled or permitted to obtain awards for, and entrant expressly waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than actual, out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; (2) any and all disputes, claims, causes of action, and liability arising out of or connected in any way with this Sweepstakes and/or any Prize shall be resolved individually, without resort to any form of class action, and exclusively by arbitration under the rules of the American Arbitration Association; and (3) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event shall attorney's fees be recoverable by either party.
WINNER'S LIST: A record of the winning entries and the odds of winning will be kept on file by the Dodgers for a period of one (1) year after the drawing.
