Choose and submit your multiple choice trivia answers for all eight (8) team questions, then accurately complete the entry form with your name, full address, daytime phone number, email address and date of birth. After completing the entry form, submit it as directed. Limit one (1) entry per person, per day, per email address. Entrant must participate in the trivia section and fully complete and submit all non-optional data requested on the online entry form to be eligible. Sponsor reserves the right to disqualify any entry by any person determined to be tampering with or abusing any aspect of the Sweepstakes. Odds of Winning: Odds of winning a particular prize will be determined by the total number of eligible entries received for that prize. Drawing: Winners of each type of prize will be selected in a random drawing on or about September 9, 2008 from among all eligible entries received throughout the Sweepstakes Period for that type of prize. Sponsor will notify potential winners by email and/or phone or by other means in Sponsor's discretion on or about September 10, 2008. Promotion Entities (defined below) are not responsible if any potential winner notification is not received for any reason or is returned as undeliverable. If any potential winner does not respond within seven (7) days of the first notification attempt or is found to be ineligible or not in compliance with the Official Rules, or if the prize is declined or a notification is returned as unclaimed or undeliverable, such potential winner will forfeit his or her prize and an alternate winner will be selected. In the event of a dispute as to the identity of an online entrant, the online entry in question will be deemed submitted by the authorized account holder of the e-mail account from which it was sent provided he/she is eligible according to these Official Rules. Prizes/Approximate Retail Value ("ARV") Per Prize: Mets Tickets Grand Prize: One (1) winner will receive two (2) tickets to the September 28, 2008 Mets home game and two (2) tickets to the Mets first 2009 home game at Mets Citi Field on a date to be determined by the Mets and/or the Office of the Commissioner of Baseball, as applicable. ARV: $200 Yankees Tickets Grand Prize: One (1) winner will receive two (2) tickets to the September 21, 2008 Yankees home game and two (2) tickets to the Yankees first 2009 home game at the new Yankees Stadium on a date to be determined by the Yankees and/or the Office of the Commissioner of Baseball, as applicable. ARV: $200 Total ARV of all prizes: $400. All tickets subject to terms and conditions thereon. In the event any element of any prize becomes unavailable for any reason beyond the reasonable control of Sponsor, neither Sponsor nor any other MLB Entity shall have any obligation to provide a substitute prize. All costs and expenses not specified herein, related to the acceptance and use of prize, including but not limited to lodging, transportation costs, meals, taxes (including income and withholding taxes) and gratuities and other expenses incurred by accepting the prize are the sole responsibility of the winner. Winner's companions must be of legal age of majority in their jurisdictions of residence, unless accompanied by a parent or guardian. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the applicable Major League Baseball Club, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as prizes will govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Winner and his/her guest(s) agree to comply with all applicable stadium regulations in connection with the prize. Sponsor and the applicable MLB Entities reserve the right to remove or to deny entry to winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. The MLB Entities will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition. Prize Restrictions: Winners are solely responsible for all applicable Federal, State and local taxes on the prizes. The prizes are non-assignable and non-transferable. No prize or cash substitutions are permitted except by Sponsor at its sole discretion who reserves right to substitute a prize in whole or in part. Winners will be required to sign and return an Affidavit of Eligibility, a Liability Release and a Publicity Release, and any other documentation that Sponsor requires (collectively "Affidavit/Release") within five (5) days after receipt by winner or such potential winner will be disqualified and an alternate potential winner selected. Limit one (1) prize per person/family/household. Unclaimed prizes will not be awarded. Except where prohibited by law, by entering, winners (his/her parent/legal guardian if he/she is a resident of a jurisdiction that deems him/her to be a minor) (a) consent to the use of their names, voices, likenesses and/or biographical information for advertising and promotional purposes without additional consideration and upon request will provide such consent in writing; and (b) agree to the posting of their names, city/state of residences and/or likenesses on the Website. Eligibility: The Sweepstakes is open only to legal U.S. residents residing In New York, New Jersey or Connecticut, who are 18 years of age or older at the time of entry. Proof of age may be required. Employees, directors and officers (including immediate family members (spouse, parents, children and siblings and their respective spouses, regardless of they reside)) and members of the same household, whether or not related) of Sponsor, the MLB Entities, and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with this Sweepstakes are not eligible to participate. Entrants to the Sweepstakes will be given the option to receive commercial e-mails from Sponsor and/or MLB.com; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's consent to receive such e-mails. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM" or "MLB.com"), SportsOnEarth, LLC, Tickets.com, Inc., Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities. Conditions of Entry: By participating in this Sweepstakes, each entrant unconditionally accepts and agrees (a) to comply with and abide by these Official Rules and all decisions of Sponsor, which shall be final and binding in all respects; (b) to release, indemnify and hold harmless Promotion Entities from any claim, injury, damage, liability or loss that may occur, directly or indirectly, in whole or in part, from the participation in this Sweepstakes and/or from the acceptance, receipt and/or use of any prize or any travel or activity related to the receipt or use of any prize; (c) that Promotion Entities have not made any representations or warranties, expressed or implied, relating to the prizes; and (d) that Sponsor and/or MLBAM, at their sole discretion, have the right to terminate or suspend the Sweepstakes or any portion thereof should the integrity, fairness or proper play of the Sweepstakes (or any portion thereof) be impaired for any reason; and in such event notice thereof will be posted on the Website and prizes awarded in a random drawing from among all non-suspect, eligible entries timely and legitimately received prior to the event causing the termination or suspension. General: Promotion Entities are not responsible for: (i) electronic transmissions/entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, or not received by the Sponsor, MLBAM or any of their agents for any reason, (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries, or for destruction of or unauthorized access to, or alteration of, entries, (iii) failed or unavailable hardware, network, software or telephone, cable or satellite transmissions, cellular equipment towers, damage to entrants' or any person's computer, wireless phone/handset and/or its contents, or causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes, and/or (iv) any entries submitted in a manner that is not expressly allowed under these rules. All incomplete or non-conforming entries and their entrants will be disqualified. Promotion Entities are not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the transmission, receipt or processing of the entries; or for any errors, misprints or typographical mistakes in any printed or electronic advertising of the Sweepstakes or any prize notification. Sweepstakes entries generated by a script, macro, third-party software or website, or other mechanical or automated means will be disqualified. Sponsor and MLBAM shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. All disputes will be resolved under applicable laws of the State of Illinois and any dispute may be brought and resolved only in a federal or state court in the State of Illinois.
