MLB.com Beat the Streak -- Official Rules NO PURCHASE NECESSARY TO ENTER OR WIN The object of MLB.com Beat the Streak (the "Contest") is to establish a virtual "hitting streak" and keep it going for as long as possible. You'll do this by selecting one Major League Baseball ("MLB") player each game day, from a list displayed by MLB.com of MLB players who are on a MLB Club's active roster on that game day. If the player you select for that game day gets at least one hit in that day's games, your streak continues. If the player you select does not get a hit, you can still participate, but your streak is reset to zero. You must select a player each game day; however, you can make your daily player selections for up to ten (10) calendar days in the future. If you fail to select a player for any game day, your streak will automatically reset to zero. You can select any player as many times as you want over the course of the Contest Period (as defined below). Eligibility The Contest is open only to legal residents of the fifty (50) United States and Washington D.C., and Canada (excluding residents of the Province of Quebec) who are of legal age of majority in their jurisdictions of residence (and at least 18 in the U.S.) as of the date of entry with a valid e-mail address and Internet access as of April 5, 2009. Void in the Province of Quebec and where prohibited by law, rule or regulation. Employees or consultants of the MLB Entities (defined below) or any of their respective parents, affiliates, subsidiaries or advertising and promotion agencies, and their immediate family members (parent, sibling, child or spouse and their respective spouses, regardless of where they reside) and any person residing in their same households, whether or not related, are not eligible to participate or win a prize. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM" or "MLB.com"), Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, Tickets.com, Inc., SportsOnEarth, LLC and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities. Contest Period The Contest begins on April 6, 2009 and ends following the conclusion of the final game of the 2009 MLB regular season (the "Contest Period"). How to Register There are two (2) ways to register to participate in the Contest: online at www.mlb.com (the "MLB.com Portal") or via the MLB.com wireless website located at wap.mlb.com (the "MLB.com Mobile Site"). No other method of registration will be accepted. Limit one (1) registration per person and per unique email address, regardless of method of registration. In case of multiple registrations received from any person or email address, only the first registration received from such person or email address will be considered. 1. Online Registration via the MLB.com Portal: To register online to participate, beginning at 12:01 a.m. Eastern Time ("ET") on April 6, 2009 and ending at 11:59 p.m. ET on September 14, 2009, visit www.mlb.com/fantasy and click on the banners, buttons and/or links for the Contest to access the Contest registration page, then follow the directions provided. 2. Mobile Registration via the MLB.com Mobile Site: Beginning at 11:59 p.m. ET on June 1, 2009 and ending at 11:59 p.m. ET on September 14, 2009, you can register for the Contest via the MLB.com Mobile Site using an activated "smartphone" with Internet capabilities (a "Smartphone"). To register, access the Contest registration page on the MLB.com Mobile Site by typing wap.mlb.com into the mobile browser of your Smartphone, then clicking on the banners and/or the text link(s) for the Contest on the home page of MLB.com Mobile Site. Registrations generated by script, macro or other automated means will be void. Game Administration By registering and/or participating, participants agree that MLBAM will solely resolve any disputes and rules violations that arise in connection with the Contest. All decisions by MLBAM regarding the Contest shall be final and binding in all respects. Any incidence of collusion or cheating, as determined by MLBAM in its sole discretion, will be subject to disqualification from the Contest without limitation to any other rights or remedies available to MLBAM. Selecting Your Players Each day on which an MLB game is played during the Contest Period (each, a "Game Day"), you must select one (1) player from a list displayed by MLB.com of MLB players who are on a MLB Club's active roster on that Game Day. If you fail to select a player for any Game Day, your streak will reset to zero. The list of available players may change as a result of injury or other roster changes, so be alert. You may select any player from the list of MLB players who are on a MLB Club's active roster on that Game Day, including a player you have previously chosen. You will have until five (5) minutes prior to the start of the first MLB game being played on that Game Day to make your player selection for that Game Day, after which you may not submit a player or change your selection; however, you can make your daily player selection up to ten (10)-calendar days prior to any Game Day and may change your selection until five (5) minutes prior to the start of the first MLB game being played on that Game Day. MLB.com's computer shall be the official clock of the Contest. Establishing and Maintaining a Streak All participants start at zero. Your streak is measured by the number of consecutive Game Day(s) the player(s) you select are credited with a hit during the Contest Period. If you select a player for any Game Day who does not get a hit during the Game Day for which you selected him, your streak ends and must start to build your streak again from zero. If for any reason a player you select does not play during the Game Day for which you selected him, your streak will NOT end. A hitting streak will also NOT end if each of the selected player's plate appearances (one or more) result in a base on balls, hit batsman, defensive interference or a sacrifice bunt. A hitting streak will end if the player has a sacrifice fly and no hit. Except as set forth in the Suspended Games Sections below, your streak will remain intact in the event of any cancelled or postponed MLB game. The foregoing is based on official scoring as confirmed by MLBAM. In the event that a player you select plays in a double-header, your streak will only continue if the player gets at least one hit in both games in which he plays on that Game Day unless all the selected player's plate appearances (one or more) result in a base on balls, hit batsman, defensive interference or a sacrifice bunt. For the avoidance of doubt, in the event that a player you select gets at least one hit in both games of a double-header, your streak will continue, but your streak will only increase by one (1) hit for that Game Day, and not two (2) hits. NOTE: Except as set forth in the Suspended Games section below, only hits officially scored as hits in 2009 MLB regular season games will be counted as valid hits in the Contest. Suspended Games The following shall apply in the event any 2009 MLB game(s) is suspended during the Contest Period (each, a "Suspended Game"): 1) In the event any Suspended Game(s) is subsequently completed within three (3) calendar days immediately following the date on which any such game(s) was suspended, for purposes of this Contest, all hits officially scored as hits for such Suspended Game(s) shall count as valid hits for the Game Day on which such Suspended Game(s) was originally scheduled. Example: A participant selects Dustin Pedroia to hit on the May 4th game that is suspended. Pedroia goes 0-for-2 in the first part of the game that is suspended on May 4th, but gets a hit in the portion of the Suspended Game that is resumed the next day, May 5th. In this case, although Pedroia's hit took place on May 5th, for purposes of this Contest, the hit would count as a valid hit for May 4th, Game Day on which such Suspended Game(s) was originally scheduled. 2) In the event any Suspended Game(s) is not completed within three (3) calendar days immediately following the date on which such game(s) was suspended, for purposes of this Contest, ONLY hits officially scored as hits in the portion of the game(s) that was played prior to the suspension will count as valid hits for the Game Day on which such Suspended Game(s) was originally scheduled, provided either of the following conditions apply at the time such game(s) is suspended: a. The MLB Club that is trailing in the portion of the game that was suspended (i) has made fifteen (15) or more outs in the game, and/or (ii) has completed all of its at-bats for five (5) innings; or b. The home MLB Club (i) has made fifteen (15) or more outs, (ii) has completed all of its at-bats for five (5) innings, and/or (iii) has tied the game in the bottom of the fifth inning. Under any of these circumstances, for purposes of this Contest, only hits officially scored as hits in the portion of the game(s) that was played prior to the suspension will count as valid hits for the Game Day on which such Suspended Game (s) was originally scheduled. As such, any hits officially scored as hits from any portion of any Suspended Game(s) that is completed four (4) or more calendar days immediately following the date on which the game(s) is suspended will NOT count as valid hits for purposes of this Contest. Example: A game started on Wednesday, May 27th between the Red Sox and Twins is suspended with the score tied at 2-2 in the 7th inning. The game isn't resumed until Sunday, May 31st (i.e., four (4) calendar days later), and the Red Sox go on to win 3-2. In this case, all hits officially scored as hits from the first portion of the game (i.e., the portion played on May 27th, prior to the game being suspended) will count as valid hits for the May 27th game. Any hits officially scored as hits from the second portion of the game that was completed on May 31st will NOT count toward either game played on May 27th or May 31st. 3) In the event any Suspended Game(s) is not completed within three (3) calendar days immediately following the date on which the game(s) was suspended, any hits officially scored as hits in any portion of such Suspended Game(s) will NOT count as valid hits for purposes of this Contest provided either of the following conditions apply at the time such game(s) is suspended: a. The MLB Club which is trailing has NOT (i) made fifteen (15) or more outs in the game, and/or (ii) completed all of its at-bats for five (5) innings; or b. An MLB game is tied and the visiting MLB Club has NOT (i) made fifteen (15) outs or more in the game, or (ii) completed all of its at-bats for five (5) or more innings. Under either of these circumstances, hits officially scored as hits for any portion(s) of any Suspended Game(s) will NOT count as valid hits for purposes of this Contest. In other words, such hits shall not apply to either the (1) Game Day on which the Suspended Game(s) was originally scheduled, or (2) Game Day on which the Suspended Game(s) was completed. Example: A game played on Wednesday, June 3rd between the Angels and Blue Jays is suspended with the score tied at 4-4 in the 4th inning. The game isn't resumed until Sunday, June 7th (i.e., four (4) calendar days later), and the Angels go on to win 8-5. In this case, none of the hits officially scored as hits will count for either part of the game and accordingly, for either Game Day of a Contest participant's streak. Stat Corrections Your hit totals will not be updated to reflect official MLB statistics corrections that occur more than three (3) calendar days after the completion of an entire Game Day's schedule of games. For example, for a game played on Saturday, April 4, the official scoring change would have to be made on or before Tuesday, April 7, to count toward a user's streak. If a scoring change for the Saturday, April 4 game were to take place on Wednesday, April 8 (i.e., four (4) calendar days later), the scoring change would NOT be reflected in your hit streak. PRIZES Prize winner(s) are fully responsible for any and all applicable federal, state, provincial and local taxes (including income and withholding taxes). All costs and expenses not specified herein as being provided related to the acceptance and use of any prize are the sole responsibility of the winners. Cash prizes will be awarded in the form of a check in U.S. dollars (please see specific details for the manner in which the 57-Game Hitting Streak Prize (as described below) will be awarded). Gift certificates and subscriptions may be subject to certain terms and conditions as specified by issuer. Prizes are non-transferable and non-assignable, with no cash redemptions except in MLBAM's sole and absolute discretion. MLBAM reserves the right to substitute a prize of comparable or greater value at its sole and absolute discretion. All prize details are at the sole discretion of the MLBAM. NO PRIZES WILL BE AWARDED IF NO PARTICIPANT ACHIEVES A HITTING STREAK OF AT LEAST TWENTY (20) GAMES. 57-Game Hitting Streak Prize The first eligible participant, if any, to achieve at least a fifty-seven (57) game hitting streak, as determined by MLBAM in its sole discretion, will win the 57-Game Hitting Streak Prize as described below ("57-Game Hitting Streak Prize"). For the avoidance of doubt, a maximum of one (1) 57-Game Hitting Streak Prize will be awarded for the entire Contest. Beginning as of April 6, 2009 and continuing through the completion of MLB games that start as of May 31, 2009, the 57-Game Hitting Streak Prize will be one million dollars (US$1,000,000). If no eligible participant achieves at least a fifty-seven (57) game hitting streak as of the completion of MLB games played between April 6, 2009 and May 31, 2009, as determined by MLBAM in its sole discretion, then beginning on June 1, 2009 and each Game thereafter at 10:10 AM ET, the 57-Game Hitting Streak Prize will increase by ten thousand dollars (US$10,000) each Game Day until the earlier of (a) any eligible participant achieves a fifty-seven (57) game hitting streak, or (b) the 57-Game Hitting Streak Prize is increased to a total maximum of one million five hundred thousand dollars (US$1,500,000). For the avoidance of doubt, the 57-Game Hitting Streak Prize will not be subject to any increase if any eligible participant achieves a fifty-seven (57) game hitting streak as of the completion of the final game played on May 31, 2009 or after the 57-Game Hitting Streak Prize has increased to a total maximum of $US$1,500,000 (as applicable). By way of example only, if the first eligible participant achieves a fifty-seven (57) game hitting streak on June 17, 2009, the eligible participant would win $1,170,000 (i.e., $1,000,000 + $10,000 multiplied by 17 Game Days following completion of the May 31st games)). NOTE: 57-Game Hitting Streak Prize will only be awarded if an eligible participant achieves a hit streak greater than or equal to fifty-seven (57), as determined by MLBAM. The 57-Game Hitting Streak Prize will be awarded as the winner's choice of either a twenty (20) year annuity or as one lump sum payment representing the present value of that annuity as of March 2009. The size of the annuity and the lump sum payment will depend upon the value of the 57-Game Hitting Streak Prize on the date on which the fifty-seven (57) game hitting streak is achieved. The annuity will range from fifty thousand dollars (US$50,000) per year for twenty (20) years (equaling one million dollars (US$1,000,000)) to seventy-five thousand dollars (US$75,000) per year for twenty (20) years (equaling one million five hundred dollars (US$1,500,000)) and the lump sum payment will range from the estimated present value of one million dollars US$1,000,000 as of March 2009 of approximately six hundred sixty-six thousand eight hundred seventeen dollars and eighty-five cents(US$666,817.85) to the estimated present value of one million five hundred thousand dollars US$1,500,000 as of March 2009 of approximately one million two hundred twenty-six dollars and seventy cents (US$1,000,226.70). Grand Prize If no participant achieves a 57-game hitting streak or greater during the Contest Period, as determined by MLBAM, the eligible participant with the longest hitting streak greater than or equal to twenty (20) will win ten thousand dollars (US $10,000) (the "Grand Prize"). NOTE: Grand Prize will only be awarded if (i) no eligible participant achieves at least a fifty-seven (57) game hitting streak and (ii) an eligible participant achieves a hitting streak greater than or equal to twenty (20), as determined by MLBAM. The Grand Prize will be awarded in the form of a check as one (1) lump sum payment. In the event two (2) or more eligible participants each achieve a fifty-seven (57) game streak on the same Game Day, tiebreakers will determine the 57-Game Hitting Streak Prize winner using the tiebreakers described below. Example: Participant 1 achieves a fifty-seven (57) game hitting streak at 7:13 p.m. ET on July 28th, when Derek Jeter (Participant 1's selection) singles against the Blue Jays, and Participant 2 achieves a fifty-seven (57) game hitting streak at 1:03 a.m. ET on July 29th, when Jason Giambi (Participant 2's selection) homers against the Angels. Since both games' start times were scheduled for July 28, 2009, tiebreakers will determine the 57-Game Hitting Streak Prize winner. Tiebreakers for 57-Game Hitting Streak Prize or Grand Prize In the event of a tie at any of these prize levels, tiebreakers will be used among the remaining tied participants in the following order: 1. Total number of hits during the streak of all the players the participant selected; 2. Total number of hits by the player the participant selected on the most recent Game Day of the streak, going back one Game Day at a time until the tie is broken; 3. Total bases during the streak of all the players the participant selected; 4. Total bases by the player the participant selected on the most recent Game Day of the streak, going back one Game Day at a time until the tie is broken; and 5. MLBAM will administer a timed baseball trivia quiz, testing the tied participants' knowledge of Major League Baseball, until the tie is broken. 45-Game Hitting Streak (One more than current National League record) Any eligible participant who achieves at least a 45-game hitting streak, as determined by MLBAM in its sole discretion, will win one (1) US$100 gift certificate to the MLB.com Shop. 35-Game Hitting Streak (One more than current MLB Rookie Record) Any eligible participant who achieves at least a 35-game hitting streak, as determined by MLBAM in its sole discretion, will win one (1) US$50 gift certificate to the MLB.com Shop. 30-Game Hitting Streak Any eligible participant who achieves at least a 30-game hitting streak, as determined by MLBAM in its sole discretion, will win one (1) free subscription to MLB.TV for a one-month period, beginning on the first calendar day of the month following the achievement of the 30-game streak. Example: if an eligible participant reaches 30 games on July 23, the MLB.TV subscription would run from Aug. 1-31. If an eligible participant reaches 30 games in the month of September, that participant will win one (1) free subscription to MLB.com's 2009 Postseason MLB.TV package. MLBAM reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest. The Released Parties make no warranties, express or implied, relative to the use or enjoyment of any prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. If you fail to select a player for any game day, your streak will automatically reset to zero. You can select any player as many times as you want over the course of the Contest Period (as defined below). Eligibility The Contest is open only to legal residents of the fifty (50) United States and Washington D.C., and Canada (excluding residents of the Province of Quebec) who are of legal age of majority in their jurisdictions of residence (and at least 18 in the U.S.) as of the date of entry with a valid e-mail address and Internet access as of April 5, 2009. Void in the Province of Quebec and where prohibited by law, rule or regulation. Employees or consultants of the MLB Entities (defined below) or any of their respective parents, affiliates, subsidiaries or advertising and promotion agencies, and their immediate family members (parent, sibling, child or spouse and their respective spouses, regardless of where they reside) and any person residing in their same households, whether or not related, are not eligible to participate or win a prize. Game Administration By registering and/or participating, participants agree that MLBAM will solely resolve any disputes and rules violations that arise in connection with the Contest. All decisions by MLBAM regarding the Contest shall be final and binding in all respects. Any incidence of collusion or cheating, as determined by MLBAM in its sole discretion, will be subject to disqualification from the Contest without limitation to any other rights or remedies available to MLBAM. Selecting Your Players Each day on which an MLB game is played during the Contest Period (each, a "Game Day"), you must select one (1) player from a list displayed by MLB.com of MLB players who are on a MLB Club's active roster on that Game Day. If you fail to select a player for any Game Day, your streak will reset to zero. The list of available players may change as a result of injury or other roster changes, so be alert. You may select any player from the list of MLB players who are on a MLB Club's active roster on that Game Day, including a player you have previously chosen. You will have until five (5) minutes prior to the start of the first MLB game being played on that Game Day to make your player selection for that Game Day, after which you may not submit a player or change your selection; however, you can make your daily player selection up to ten (10)-calendar days prior to any Game Day and may change your selection until five (5) minutes prior to the start of the first MLB game being played on that Game Day. MLB.com's computer shall be the official clock of the Contest. Establishing and Maintaining a Streak All participants start at zero. Your streak is measured by the number of consecutive Game Day(s) the player(s) you select are credited with a hit during the Contest Period. If you select a player for any Game Day who does not get a hit during the Game Day for which you selected him, your streak ends and must start to build your streak again from zero. If for any reason a player you select does not play during the Game Day for which you selected him, your streak will NOT end. A hitting streak will also NOT end if each of the selected player's plate appearances (one or more) result in a base on balls, hit batsman, defensive interference or a sacrifice bunt. A hitting streak will end if the player has a sacrifice fly and no hit. Except as set forth in the Suspended Games Sections below, your streak will remain intact in the event of any cancelled or postponed MLB game. The foregoing is based on official scoring as confirmed by MLBAM. In the event that a player you select plays in a double-header, your streak will only continue if the player gets at least one hit in both games in which he plays on that Game Day unless all the selected player's plate appearances (one or more) result in a base on balls, hit batsman, defensive interference or a sacrifice bunt. For the avoidance of doubt, in the event that a player you select gets at least one hit in both games of a double-header, your streak will continue, but your streak will only increase by one (1) hit for that Game Day, and not two (2) hits. NOTE: Except as set forth in the Suspended Games section below, only hits officially scored as hits in 2009 MLB regular season games will be counted as valid hits in the Contest. Suspended Games The following shall apply in the event any 2009 MLB game(s) is suspended during the Contest Period (each, a "Suspended Game"): 1) In the event any Suspended Game(s) is subsequently completed within three (3) calendar days immediately following the date on which any such game(s) was suspended, for purposes of this Contest, all hits officially scored as hits for such Suspended Game(s) shall count as valid hits for the Game Day on which such Suspended Game(s) was originally scheduled. Example: A participant selects Dustin Pedroia to hit on the May 4th game that is suspended. Pedroia goes 0-for-2 in the first part of the game that is suspended on May 4th, but gets a hit in the portion of the Suspended Game that is resumed the next day, May 5th. In this case, although Pedroia's hit took place on May 5th, for purposes of this Contest, the hit would count as a valid hit for May 4th, Game Day on which such Suspended Game(s) was originally scheduled. 2) In the event any Suspended Game(s) is not completed within three (3) calendar days immediately following the date on which such game(s) was suspended, for purposes of this Contest, ONLY hits officially scored as hits in the portion of the game(s) that was played prior to the suspension will count as valid hits for the Game Day on which such Suspended Game(s) was originally scheduled, provided either of the following conditions apply at the time such game(s) is suspended: a. The MLB Club that is trailing in the portion of the game that was suspended (i) has made fifteen (15) or more outs in the game, and/or (ii) has completed all of its at-bats for five (5) innings; or b. The home MLB Club (i) has made fifteen (15) or more outs, (ii) has completed all of its at-bats for five (5) innings, and/or (iii) has tied the game in the bottom of the fifth inning. Under any of these circumstances, for purposes of this Contest, only hits officially scored as hits in the portion of the game(s) that was played prior to the suspension will count as valid hits for the Game Day on which such Suspended Game (s) was originally scheduled. As such, any hits officially scored as hits from any portion of any Suspended Game(s) that is completed four (4) or more calendar days immediately following the date on which the game(s) is suspended will NOT count as valid hits for purposes of this Contest. Example: A game started on Wednesday, May 27th between the Red Sox and Twins is suspended with the score tied at 2-2 in the 7th inning. The game isn't resumed until Sunday, May 31st (i.e., four (4) calendar days later), and the Red Sox go on to win 3-2. In this case, all hits officially scored as hits from the first portion of the game (i.e., the portion played on May 27th, prior to the game being suspended) will count as valid hits for the May 27th game. Any hits officially scored as hits from the second portion of the game that was completed on May 31st will NOT count toward either game played on May 27th or May 31st. 3) In the event any Suspended Game(s) is not completed within three (3) calendar days immediately following the date on which the game(s) was suspended, any hits officially scored as hits in any portion of such Suspended Game(s) will NOT count as valid hits for purposes of this Contest provided either of the following conditions apply at the time such game(s) is suspended: a. The MLB Club which is trailing has NOT (i) made fifteen (15) or more outs in the game, and/or (ii) completed all of its at-bats for five (5) innings; or b. An MLB game is tied and the visiting MLB Club has NOT (i) made fifteen (15) outs or more in the game, or (ii) completed all of its at-bats for five (5) or more innings. Under either of these circumstances, hits officially scored as hits for any portion(s) of any Suspended Game(s) will NOT count as valid hits for purposes of this Contest. In other words, such hits shall not apply to either the (1) Game Day on which the Suspended Game(s) was originally scheduled, or (2) Game Day on which the Suspended Game(s) was completed. Example: A game played on Wednesday, June 3rd between the Angels and Blue Jays is suspended with the score tied at 4-4 in the 4th inning. The game isn't resumed until Sunday, June 7th (i.e., four (4) calendar days later), and the Angels go on to win 8-5. In this case, none of the hits officially scored as hits will count for either part of the game and accordingly, for either Game Day of a Contest participant's streak. Stat Corrections Your hit totals will not be updated to reflect official MLB statistics corrections that occur more than three (3) calendar days after the completion of an entire Game Day's schedule of games. For example, for a game played on Saturday, April 4, the official scoring change would have to be made on or before Tuesday, April 7, to count toward a user's streak. If a scoring change for the Saturday, April 4 game were to take place on Wednesday, April 8 (i.e., four (4) calendar days later), the scoring change would NOT be reflected in your hit streak. PRIZES Prize winner(s) are fully responsible for any and all applicable federal, state, provincial and local taxes (including income and withholding taxes). All costs and expenses not specified herein as being provided related to the acceptance and use of any prize are the sole responsibility of the winners. Cash prizes will be awarded in the form of a check in U.S. dollars (please see specific details for the manner in which the 57-Game Hitting Streak Prize (as described below) will be awarded). Gift certificates and subscriptions may be subject to certain terms and conditions as specified by issuer. Prizes are non-transferable and non-assignable, with no cash redemptions except in MLBAM's sole and absolute discretion. MLBAM reserves the right to substitute a prize of comparable or greater value at its sole and absolute discretion. All prize details are at the sole discretion of the MLBAM. NO PRIZES WILL BE AWARDED IF NO PARTICIPANT ACHIEVES A HITTING STREAK OF AT LEAST TWENTY (20) GAMES. 57-Game Hitting Streak Prize The first eligible participant, if any, to achieve at least a fifty-seven (57) game hitting streak, as determined by MLBAM in its sole discretion, will win the 57-Game Hitting Streak Prize as described below ("57-Game Hitting Streak Prize"). For the avoidance of doubt, a maximum of one (1) 57-Game Hitting Streak Prize will be awarded for the entire Contest. Beginning as of April 6, 2009 and continuing through the completion of MLB games that start as of May 31, 2009, the 57-Game Hitting Streak Prize will be one million dollars (US$1,000,000). If no eligible participant achieves at least a fifty-seven (57) game hitting streak as of the completion of MLB games played between April 6, 2009 and May 31, 2009, as determined by MLBAM in its sole discretion, then beginning on June 1, 2009 and each Game thereafter at 10:10 AM ET, the 57-Game Hitting Streak Prize will increase by ten thousand dollars (US$10,000) each Game Day until the earlier of (a) any eligible participant achieves a fifty-seven (57) game hitting streak, or (b) the 57-Game Hitting Streak Prize is increased to a total maximum of one million five hundred thousand dollars (US$1,500,000). For the avoidance of doubt, the 57-Game Hitting Streak Prize will not be subject to any increase if any eligible participant achieves a fifty-seven (57) game hitting streak as of the completion of the final game played on May 31, 2009 or after the 57-Game Hitting Streak Prize has increased to a total maximum of $US$1,500,000 (as applicable). By way of example only, if the first eligible participant achieves a fifty-seven (57) game hitting streak on June 17, 2009, the eligible participant would win $1,170,000 (i.e., $1,000,000 + $10,000 multiplied by 17 Game Days following completion of the May 31st games)). NOTE: 57-Game Hitting Streak Prize will only be awarded if an eligible participant achieves a hit streak greater than or equal to fifty-seven (57), as determined by MLBAM. The 57-Game Hitting Streak Prize will be awarded as the winner's choice of either a twenty (20) year annuity or as one lump sum payment representing the present value of that annuity as of March 2009. The size of the annuity and the lump sum payment will depend upon the value of the 57-Game Hitting Streak Prize on the date on which the fifty-seven (57) game hitting streak is achieved. The annuity will range from fifty thousand dollars (US$50,000) per year for twenty (20) years (equaling one million dollars (US$1,000,000)) to seventy-five thousand dollars (US$75,000) per year for twenty (20) years (equaling one million five hundred dollars (US$1,500,000)) and the lump sum payment will range from the estimated present value of one million dollars US$1,000,000 as of March 2009 of approximately six hundred sixty-six thousand eight hundred seventeen dollars and eighty-five cents(US$666,817.85) to the estimated present value of one million five hundred thousand dollars US$1,500,000 as of March 2009 of approximately one million two hundred twenty-six dollars and seventy cents (US$1,000,226.70). Grand Prize If no participant achieves a 57-game hitting streak or greater during the Contest Period, as determined by MLBAM, the eligible participant with the longest hitting streak greater than or equal to twenty (20) will win ten thousand dollars (US $10,000) (the "Grand Prize"). NOTE: Grand Prize will only be awarded if (i) no eligible participant achieves at least a fifty-seven (57) game hitting streak and (ii) an eligible participant achieves a hitting streak greater than or equal to twenty (20), as determined by MLBAM. The Grand Prize will be awarded in the form of a check as one (1) lump sum payment. In the event two (2) or more eligible participants each achieve a fifty-seven (57) game streak on the same Game Day, tiebreakers will determine the 57-Game Hitting Streak Prize winner using the tiebreakers described below. Example: Participant 1 achieves a fifty-seven (57) game hitting streak at 7:13 p.m. ET on July 28th, when Derek Jeter (Participant 1's selection) singles against the Blue Jays, and Participant 2 achieves a fifty-seven (57) game hitting streak at 1:03 a.m. ET on July 29th, when Jason Giambi (Participant 2's selection) homers against the Angels. Since both games' start times were scheduled for July 28, 2009, tiebreakers will determine the 57-Game Hitting Streak Prize winner. Tiebreakers for 57-Game Hitting Streak Prize or Grand Prize In the event of a tie at any of these prize levels, tiebreakers will be used among the remaining tied participants in the following order: 1. Total number of hits during the streak of all the players the participant selected; 2. Total number of hits by the player the participant selected on the most recent Game Day of the streak, going back one Game Day at a time until the tie is broken; 3. Total bases during the streak of all the players the participant selected; 4. Total bases by the player the participant selected on the most recent Game Day of the streak, going back one Game Day at a time until the tie is broken; and 5. MLBAM will administer a timed baseball trivia quiz, testing the tied participants' knowledge of Major League Baseball, until the tie is broken. 45-Game Hitting Streak (One more than current National League record) Any eligible participant who achieves at least a 45-game hitting streak, as determined by MLBAM in its sole discretion, will win one (1) US$100 gift certificate to the MLB.com Shop. 35-Game Hitting Streak (One more than current MLB Rookie Record) Any eligible participant who achieves at least a 35-game hitting streak, as determined by MLBAM in its sole discretion, will win one (1) US$50 gift certificate to the MLB.com Shop. 30-Game Hitting Streak Any eligible participant who achieves at least a 30-game hitting streak, as determined by MLBAM in its sole discretion, will win one (1) free subscription to MLB.TV for a one-month period, beginning on the first calendar day of the month following the achievement of the 30-game streak.
