![]() MLB.com Home Run Derby Challenge Official Rules (the "Official Rules")
NO PURCHASE NECESSARY TO ENTER OR WIN Introduction The object of MLB.com Home Run Derby Challenge (the "Contest") is to apply your skill and knowledge of Major League Baseball to select the correct order of finish (ranked from highest to lowest number of home runs) for each of the three rounds of the 2007 Major League Baseball Home Run Derby competition (the "Home Run Derby"), to be held at 8:00 PM Eastern Time ("ET") on July 9, 2007 in San Francisco, California. To enter, you must complete an online form by selecting for each round, the order you think the MLB players participating in the Home Run Derby will finish in each round of the Home Run Derby, as well as the answers to two tiebreaker questions. Eligibility The Contest is open only to legal residents of the fifty (50) United States, Washington D.C. (excluding residents of Louisiana), and Canada (excluding residents of the Province of Quebec) who are of legal age of majority in their jurisdictions of residence as of the date of entry with a valid Internet e-mail address as of July 4, 2007. Excluded residents may participate in the Contest, but WILL NOT be eligible to win or receive any prizes. Void outside the fifty (50) United States and Washington D.C., in Louisiana, the Providence of Quebec and where prohibited by law. Employees or consultants of the MLB Entities (defined below) or any of their respective parents, affiliates, subsidiaries, or advertising and promotion agencies, or the immediate family (parent, sibling, child or spouse) or any person residing in the same household as any such employee or consultant of the above, whether or not related, are not eligible to participate or win a prize. The "MLB Entities" shall mean MLB Advanced Media, L.P. ("MLBAM"), the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions), the Major League Baseball Clubs, Tickets.com, Inc., SportsOnEarth, LLC and each of their respective subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities. How to Register You may register to participate in the Contest from 4:00 p.m. ET on July 8, 2007 through 7:59 p.m. ET on July 9, 2007 (the "Registration Period"). Limit one (1) registration per unique email address. To register to participate online, during the Registration Period visit www.mlb.com and follow the banners, buttons and/or links for the Contest registration page. All information submitted by entrants is subject to, and will be treated in a manner consistent with, MLB.com's Privacy Policy accessible at: mlb.mlb.com/mlb/help/mlb_help_about_privacy.jsp. Game Administration By participating, participants agree that MLBAM will be responsible for resolving any disputes and rules violations that arise in connection with the Contest. All decisions by MLBAM regarding the Contest shall be final and binding in all respects. If you have any questions regarding the Contest, please send an e-mail to MLB.com customer support. How to Play Making your picks The eight (8) MLB players participating in the Home Run Derby will be posted by MLBAM at www.mlb.com after all participants have been confirmed. Your goal is to select the correct order of finish (ranked from highest to lowest number of home runs) for each round of the three rounds of the Home Run Derby. To do this, simply select the order of finish from the dropdown lists displayed in an online form on www.mlb.com. For Round 1, you must rank the eight players, 1-8, in the order you think they will finish in Round 1. After completing Round 1, your top four (4) Round 1 choices will appear for Round 2. You must then rank the four players, 1-4, in the order you think they will finish in Round 2. After completing Round 2, your top two (2) Round 2 choices will appear for Round 3. You must then rank the two players, 1-2, in the order you think they will finish in Round 3.
In addition, you must also select an answer to each of the following tiebreaker questions: Only one entry may be submitted per valid e-mail address. If a user submits multiple entries using the same e-mail address, the most recent submission will be considered that user's submission for that valid e-mail address. Player Selection Deadline You will have until 7:59 PM ET on July 9, 2007 to submit your picks. MLBAM's computer shall be the official clock of the Contest. Player Replacements Eight (8) MLB players will initially be selected to participate in the Home Run Derby. In the event that a MLB player drops out and is replaced by another MLB player, the following method will be used to determine replacements in MLB.com Home Run Derby Challenge: If a player drops out of the HR Derby prior to the start of the event, a replacement player will be named. As soon as the replacement player is named, he will also be inserted into the Contest, replacing the player that dropped out. In the event that two players drop out at the same time, and two replacements are announced at the same time, the replacements will be based off last name alphabetical order. Example: If Smith and Williams drop out at the same time, and Brown and Johnson are named as replacements, Brown would replace Smith and Johnson would replace Williams in the Contest. Scoring Scoring in MLB.com Home Run Derby Challenge is as follows:

Round 1: Total home runs hit by each MLB player in Round 1 In an event of a tie between two MLB players in Rounds 1 or 2, the following tiebreakers will be used to determine final order of finish:

Round 2: A perfect score would be one hundred and twenty (120) points if a participant correctly chooses the order of finish in all three rounds of the Home Run Derby. NOTE: Only home runs officially scored as home runs in the Home Run Derby will be counted in the Contest. PRIZES Cash prizes will be awarded in the form of a check. Prizes are non-transferable and non-assignable, with no cash redemptions or substitutions except by MLBAM, who reserves the right to substitute a prize of comparable or greater value at its sole discretion. Each winner is fully responsible for any and all applicable federal, state, provincial and local taxes (including income and withholding taxes). All costs and expenses associated with prize acceptance and use not specified herein as being provided including, but not limited to, lodging, all transportation costs, meals, gratuities, souvenirs and all other expenses incurred by accepting the prize are the sole responsibility of the winner. NO PRIZES WILL BE AWARDED IF NO PARTICIPANT ACCUMULATES AT LEAST FIFTY (50) POINTS. Perfect Prize One (1) eligible participant, if any, to accumulate one hundred and twenty (120) points ("Perfect Prize"), as determined by MLBAM in its sole discretion, will win ten thousand dollars (US$10,000). Grand Prize If no participant accumulates 120 points, the eligible participant with the most points will be the Grand Prize winner and will win two (2) tickets to the 2008 MLB All-Star Game to be played at Yankee Stadium in Bronx, NY (the "Grand Prize") (Estimated retail price of Grand Prize: US$300). NOTE: Grand Prize will only be awarded if (i) no eligible participant accumulates one hundred and twenty (120) points, and (ii) an eligible participant accumulates at least fifty (50) points. TRANSPORTATION TO/FROM THE 2008 ALL-STAR GAME NOT INCLUDED. Seat locations at the 2008 MLB All-Star Game shall be selected by MLBAM at its sole and absolute discretion. Major League Baseball game and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and may be subject to change. Grand Prize winner's companions must be of legal age of majority in their jurisdictions of residence, unless traveling with a parent or guardian. Grand Prize does not include tickets to All-Star Sunday, Home Run Derby, All-Star Workout Day, MLB All-Star FanFest or any other event or exhibition during the 2008 MLB All-Star Week apart from the 2008 MLB All-Star Game. The terms and conditions of the tickets awarded as prizes will govern in the event a legal game or exhibition, as defined by Major League Baseball, is not played due to weather, an act of God, an act of terrorism, civil disturbance or any other reason. Winner agrees to comply with all applicable stadium regulations in connection with the Grand Prize. The applicable MLB Entities reserve the right to remove or to deny entry to winner and/or guest who engages in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game or exhibition. The MLB Entities and each of their respective parent companies, trustees, subsidiaries, franchisees, affiliates, licensees, agents, independent contractors and advertising and promotional agencies and each of their respective officers, directors, agents and employees (collectively, the "Released Parties") will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control, that may cause the cancellation of Major League Baseball games or exhibitions. Tiebreakers In the event of a tie for the Perfect Prize or Grand Prize, tiebreakers will be used in the following order:
1. Participant finishing closest to the total number of home runs hit in the first round, by all eight players combined. Legal Disclaimers General Conditions By participating, each participant accepts and agrees to be bound by these Official Rules, the MLB.com Privacy Policy and Website Terms of Use, and by the decision(s) of MLBAM which shall be final and binding in all respects. Taxes, if any, are the sole responsibility of the winner of any prize awarded in this Contest. An Internal Revenue Service 1099 form will be issued to winners of prizes with a retail value greater than $600.00. Each potential winner will be notified by e-mail and/or telephone (in MLBAM's discretion) and may (in MLBAM's discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). In the event that the winner does not respond to any such notification within ten (10) days, a disqualification will result and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up. Each winner may be required to submit his/her valid social security number and/or other identification to MLBAM and shall be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, where legal, Publicity within ten (10) days following issuance. Failure to submit any identification required by MLBAM or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of any prize or prize notification as undeliverable may result in disqualification and prize will be forfeited and, at MLBAM's sole discretion, awarded to the runner-up. Participants agree to allow the MLB Entities and their respective designees to use their names and likenesses in any and all mediums now or hereafter known for advertising and publicity purposes throughout the world in perpetuity, without any compensation, notification or permission unless prohibited by law. All applicable federal, state, provincial and local laws and regulations apply. This Contest and these Official Rules will be governed by the laws of the State of New York. Any court of competent jurisdiction sitting within the State of New York, New York County will be the exclusive jurisdiction and venue for any dispute arising out of or relating to this Contest or these Official Rules. Released Parties are not responsible for lost, late, stolen, garbled, delayed, undelivered or misdirected entries, selections or registrations, for incorrect, inaccurate or incomplete entry information whether caused by a participant, equipment, or technical malfunction or for any human error, technical error or malfunctions. Released Parties are not responsible for any technical, computer, network, typographical, printing, human or other errors relating to or in connection with this Contest, including, without limitation, errors or problems which may occur in connection with the offer or administration of this Contest, the processing of entries, selections or registrations, the tabulation of scores, the cancellation of games or any errors appearing in any Contest related-materials, including, but not limited to errors in advertising, the Official Rules, the selection and announcement of the Contest prize winners or the distribution of the prizes. MLBAM reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Contest. The Released Parties make no warranties, express or implied, relative to the use or enjoyment of any prize or portions thereof, including without limitations, its quality, merchantability or fitness for a particular purpose. By entering the Contest, participants agree to hold harmless and fully release the Released Parties from any and all liability for any injuries, losses, death, or damages of any kind caused by participation in the Contest or resulting from the acceptance, possession, quality, use or misuse of the Contest Prize, or any portion of any prize, including any travel or activity related hereto. MLB.com Home Run Derby Challenge is a skill contest designed to increase consumer awareness of and interest in Major League Baseball and MLB.com, the Official Site of Major League Baseball. This Contest may not be used for any form of gambling. Internet If for any reason the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, cancellation of games or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, MLBAM reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. In event of termination, MLBAM further reserves the right to award the prizes to the players with the most points, as determined by MLBAM in its sole discretion, as of the termination date. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest. CAUTION: ANY ATTEMPT BY A PARTICIPANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE MLB ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW. All entries must include a valid e-mail address for the entrant. In case of multiple entries, only the first entry received will be considered. In the event of a dispute as to the identity of a participant, an entry will be declared made by the Authorized Account Holder of the e-mail address submitted at time of entry provided he/she is eligible according to these Official Rules. "Authorized Account Holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. In the event that the Contest is challenged by any legal or regulatory authority, MLBAM reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, the Released Parties shall have no liability to any participants who are disqualified due to such an action.
