HOW TO ENTER: There are two ways to enter the One A Day® Strikeout Challenge® Sweepstakes (the "Sweepstakes"): online or by mail. No other method of entry will be accepted.
1. By mail: To enter the Grand Prize Drawing by mail, please hand-print your full name, address (including city, state and zip code), daytime telephone number (including area code), date of birth and email address (optional) on a 3 ½" x 5" card and mail in an envelope with proper postage affixed to: One A Day Strikeout Challenge SS Grand Prize Entries, PO Box 1280, Grand Rapids, MN 55745-1280. Mail in entries must be postmarked by 6/30/09 and received by 7/5/09 to be eligible for the Grand Prize drawing. To enter any Monthly Prize Drawing by mail, please hand-print your full name, address (including city, state and zip code), daytime telephone number (including area code), date of birth and email address (optional) on a 3 ½" x 5" card and mail in an envelope with proper postage affixed to: One A Day Strikeout Challenge Monthly SS Entries, PO Box 1277, Grand Rapids, MN 55745-1277. Mail in entries must be postmarked by the 30th of the applicable month of the Sweepstakes (i.e. May 30, June 30) and be received by the 6th of the subsequent month of the Sweepstakes (i.e. June 6, July 6) to be eligible for the applicable Monthly Prize drawing. Sponsor (defined below) will use e-mail addresses provided via the mail-in entry method for prize notification purposes only; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's provision of this information.
2. Online: Enter the Sweepstakes online by visiting www.mlb.com/oneaday in order to access the online entry form for the Sweepstakes. All information submitted online by entrants is subject to, and will be treated in a manner consistent with, MLB.com's Terms of Use accessible at: http://www.mlb.com/mlb/official_info/about_mlb_com/terms_of_use.jsp and Privacy Policy accessible at: www.mlb.com/privacy. Entrants must fully complete and submit all non-optional data requested on the online entry form to be eligible. Incomplete entries are void. Online entrants to the Sweepstakes will be given the option to receive commercial e-mails from Sponsor and/or MLB.com; however, eligibility to participate in the Sweepstakes is not dependent upon entrant's consent to receive such e-mails. Online entries must be received during the Promotional Period (defined below) to be eligible.
Entries into any Monthly Prize drawing which do not win must re-enter in order to be eligible to win a subsequent Monthly Prize drawing as non-winning eligible entries from one drawing will not carry-over into subsequent Monthly Prize drawings; provided, however that entry into any Monthly Prize drawing automatically enters you into the Grand Prize drawing. Limit one (1) entry per person, per household and per email address per month, regardless of method of entry. Limit two (2) entries per person, per household and per email address for the Grand Prize drawing, regardless of method of entry. Entries generated by a script, macro or other mechanical or automated means will be disqualified. The Released Parties (defined below) are not responsible for printing errors or for stolen, lost, misplaced, late, illegible, altered, forged, defective, inaccurate, incomplete, damaged, garbled, delayed, postage due, misdirected entries, email or mail. All mail-in entries become the property of Sponsor and none will be returned. Proof of e-mailing does not constitute proof of delivery.
ELIGIBILITY: Sweepstakes open only to current legal residents of the fifty (50) United States and the District of Columbia who are eighteen 18 years of age or older (except in the case of legal residents of certain states or the District of Columbia where the age of majority is greater than eighteen (18) years of age, such age of majority) as of 5/1/2009. Employees, officers, directors, agents and representatives (including their immediate family members (mother, father, sister, brother, any child, husband, wife), and those living in the same household of the foregoing, whether or not related) of Bayer HealthCare LLC, the MLB Entities and each of their respective parent companies, subsidiaries, affiliates, licensees, distributors, dealers, retailers, suppliers, printers and advertising and promotion agencies, design, web design, web hosting, law firms and, and any and all other companies associated with this Sweepstakes are not eligible to participate or win a prize in the Sweepstakes. The "MLB Entities" shall mean the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. ("MLBAM" or "MLB.com"), MLB Media Holdings, Inc., MLB Media Holdings, L.P., MLB Online Services, Inc., Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions and Major League Baseball International), the Major League Baseball Clubs, Tickets.com, Inc., SportsOnEarth, LLC and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the shareholders, parents, directors, officers, employees, representatives, agents, successors and assigns of the above entities. Void where prohibited or restricted by law, rule or regulation. The Sweepstakes is subject to all federal, state and local laws, rules and regulations.
PROMOTIONAL PERIOD: The Promotional Period begins on 5/1/09 at 10 AM Eastern Standard Time ("EST") and ends on 6/30/09 at 11:59:59 p.m. EST (the "Promotional Period").
PRIZES: One (1) Grand Prize Winner (the "Grand Prize Winner") will receive a trip for two (2) to attend the 2009 All-Star Game in St. Louis, Missouri. The trip includes, round trip coach class air transportation from a major U.S. gateway airport closest to the Winner's residence to the All-Star Game and hotel accommodations (one (1) room, standard double-occupancy) for two (2) nights and two (2) tickets to the All-Star Game. Seat locations shall be determined in Sponsor's sole and absolute discretion. Approximate retail value of Grand Prize: $3,000.00. Two (2) Monthly Prizes: $250.00 MLB.com Gift Card that will be awarded during each month of the Sweepstakes, totaling two (2) Monthly Winners ("Monthly Winner"). MLB.com Gift Cards may be subject to certain terms and conditions. See www.MLB.com/giftcardterms for details. Monthly Winners will be chosen at random from all eligible entries received (as described above). Approximate retail value of all prizes to be awarded in the Sweepstakes: $3,500.00. Any stated difference between the approximate value and actual value of Grand Prize and the Monthly Prize or any substituted prize will not be awarded. All prize details are at the sole discretion of Administrator and/or Sponsor, as applicable. Grand Prize and Monthly Prizes consists of only the items specifically listed in these Official Rules. All costs and expenses associated with prize acceptance and use not specified herein as being awarded, including but not limited to transportation costs, meals, gratuities and other expenses incurred by accepting the Grand Prize or Monthly Prize are the sole responsibility of the Grand Prize Winner or Monthly Winner. The Grand Prize and Monthly Prizes are non-transferable and no substitutions are allowed, except by Sponsor who reserves the right to substitute a prize with one of comparable or greater value, at is sole and absolute discretion. All applicable federal, state and local taxes (including income and withholding taxes) are the sole responsibility of the winner. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the applicable Major League Baseball Club, as applicable, and may be subject to change. Winner and his/her guest(s) agree to comply with all applicable stadium regulations in connection with the Grand Prize. Sponsor and the applicable MLB Entities reserve the right to remove or to deny entry to the Grand Prize Winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, exhibition or event. The Released Parties will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition. All minor guests (if any) must be the child or legal ward of the Grand Prize Winner. The Grand Prize Winner's companions must be of legal age of majority in their jurisdictions of residence, unless accompanied by a parent or guardian.
DRAWING AND NOTIFICATION:
All potential winners for the Grand Prize will be selected in a random drawing conducted on or about 07/06/2009 from among all eligible entries received during the Promotional Period. All potential winners for the Monthly Prize will be selected in a random drawing conducted on or about June 6, 2009 and July 6, 2009 from among all eligible entries received as of the applicable drawing date. Drawings will be conducted by Arrowhead Promotion, an independent judging organization whose decisions with respect to the selection of winners are final. The potential Winners will be notified by e-mail, telephone and/or mail (in the sole discretion of Sponsor) within ten (10) days of drawing. In the event that any potential winner does not respond to any such prize notification within three (3) days of date of issuance a disqualification will result and prize will be forfeited and an alternate potential winner will be chosen from among all remaining eligible entries. The potential Grand Prize Winner may be required to submit his/her valid social security number and/or other identification to Sponsor. The potential Grand Prize Winner and travel companion will be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and , where legal, Publicity, within three (3) days of date of issuance. Failure to submit any identification required by Sponsor or to return the required documents within the specified time period, noncompliance with these Official Rules or the return of any prize or prize notification as undeliverable will result in disqualification and prize will be forfeited and cause an alternative potential Grand Prize Winner to be selected from among all remaining eligible entries. The odds of winning a Monthly Prize depend on the total number of eligible entries received as of the applicable monthly drawing. The odds of winning the Grand Prize depend on the total number of eligible entries received during the Promotional Period. Limit one (1) Monthly Prize per person, family or household.
The Grand Prize Winner and Monthly Winners, by acceptance of all prizes, each grant to Sponsor, the MLB Entities and each of their respective designees the right to use and/or publicize winner's name, address (city and state of residence), photograph, voice and/or other likeness and prize information in any media now known or hereafter devised, throughout the world, in perpetuity without additional compensation or consideration, notification or permission, unless prohibited by law.
INDEMNIFICATION: By entering, each entrant releases and agrees to hold harmless Bayer HealthCare LLC, the MLB Entities and each of their respective parents, divisions, subsidiaries, affiliates, directors, officers, employees, agents, licensees, distributors, dealers, retailers, professional advisors, representatives and advertising and promotion and public relation agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively, the "Released Parties") from any and all claims, demands, losses, promises, causes of action and liabilities, injuries or damages of any kind, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, or preparation for, or participation in this Sweepstakes.
GENERAL: By participating in this Sweepstakes, you agree to be bound by these Official Rules. Participants are responsible for all costs or charges involved in accessing the World Wide Web and warrant that the cost of accessing the Internet, if any, is part of a larger agreement with an Internet Service Provider or some other means, and that the cost of this access and/or the time spent, if any, to configure their web-site is not an incremental cost in order to participate in the Sweepstakes. The Released Parties are not responsible for individuals who cannot access the Internet or cannot click-through for any period of time regardless of technical, hardware, software, telephone, Internet, virus contamination, or network problems, or delay, failure or malfunction for any reason. Sponsor and MLBAM reserve the right, in their sole discretion, to cancel, suspend or modify the Sweepstakes (or any portion thereof) if in the sole determination of Sponsor and/or MLBAM they believe that the integrity of the Sweepstakes (or any portion thereof) has been, or could be compromised or that the Sweepstakes (or any portion thereof) is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes (or any portion thereof). In the event of cancellation, Sponsor may elect to identify winners and award the prizes by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellation. Sponsor reserves the right to disqualify any entrant from the Sweepstakes if in Sponsor's sole judgment entrant has not complied with these Official Rules. Entrants will also be disqualified, at the sole discretion of Sponsor, if the entrant attempts (i) to enter the Sweepstakes through any means other than as described in these Official rules; (ii) provides information that is incorrect, inaccurate or fraudulent, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes; and/or (iii) attempts to disrupt the Sweepstakes or circumvent the terms and conditions of these Official Rules. The Released Parties will not be responsible for: (a) any late, lost, misrouted, postage due, illegible, garbled, distorted, failed or damaged satellite, telephone or cable transmissions or entries; (b) for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or problems of any kind whether human, mechanical, electronic, network, computer, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the Grand Prize or in any Sweepstakes-related materials; (c) any Sweepstakes disruptions, injuries, losses or damages , and/or (d) injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Released Parties (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND MLBAM WILL DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
All online entries must include a valid e-mail address for the entrant. In case of multiple entries received from any person or email address or household, only the first entry received from such person or email address or household will be considered. In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of entry provided he/she is eligible according to these Official Rules. The "Authorized Account Holder" is defined as the natural person to whom the applicable Internet service provider or other organization (such as a business or educational institution) has assigned the e-mail address for the domain associated with the submitted e-mail address.
LAW: This Sweepstakes is governed by the laws of the United States with venue in Morris County in the State of New Jersey.
