Eligibility: Diamond and Dreams Promotion ("Promotion") is open to legal residents of the fifty (50) United States and the District of Columbia, who are eighteen (18) years of age or older (or of the legal age of majority in their state of residence, whichever is older) as of 4/20/12. Employees, officers and directors of MLB Advanced Media, L.P. ("MLBAM," or "MLB.com" or "Sponsor"), the other MLB Entities (as defined below), General Motors LLC ("GM"), The Scotts Company, LLC, Project Support Team, Inc. ("Administrator"), and each of their respective parent companies, subsidiaries, affiliates, dealerships, governors, related entities, partners, partnerships, principals, licensees, sponsors, and advertising/promotion agencies and all of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, "Released Parties"), and the immediate family members (parent, spouse, sibling, or child, and their respective spouses, regardless of where they reside) and those living in the same household of each (whether or not related) are not eligible to participate or win. The "MLB Entities" shall mean MLBAM, the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, SportsOnEarth, LLC, Tickets.com, Inc., Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc., the Major League Baseball Clubs, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers, employees and agents of the above entities. This Promotion is subject to all applicable federal, state, and local laws. Void where prohibited or restricted by law, rule or regulation.
Promotion Period: Promotion begins at 10:00:01PM Eastern Time ("ET") on 4/20/12 and ends at 11:59:59PM ET on 7/22/12 ("Promotion Period"). The Promotion will be divided into one (1) Grand Prize Drawing, and twelve (12) Field Makeover Prize Drawings.
Four ways to Participat: During the Promotion Period, 1) Online: Visit http://secure.mlb.com/sponsors/chevy/building_diamonds/, click on the applicable promotional banners, buttons and/or links to access the online entry form. Follow the instructions provided to fully complete and submit the entry form to receive one (1) entry in the Promotion; 2) In Stadium: Visit participating Major League Baseball stadiums, and follow the instructions provided onsite to fully complete and submit the entry form to receive one (1) entry in the Promotion; 3) Participating Locations: Visit participating Chevrolet Dealerships, Lowe's retail locations, or Kansas City, MO area participating Ace Hardware Stores, follow the instructions provided fully to complete an official entry form provided on the Scotts MLB Official 2012 All-Star Game Retail ballot and deposit in the ballot box by close of business on 6/22/12 form to receive one (1) entry in the Promotion. Entries received via this method of entry will only be included in the Grand Prize drawing and Entry Period 10, 11, and 12 drawings; or 4) Wireless Application Protocol ("WAP"): Visit http://secure.mlb.com/sponsors/chevy/building_diamonds/ using your WAP enabled wireless device (Android or IOS platforms only) and follow the directions provided to fully complete and submit the Official Entry Form to receive one (1) entry in the Promotion. NOTE: You may be charged for standard data or WAP service fees according to the terms of your service agreement with your wireless phone company. Check with your wireless phone provider for capabilities, pricing plan details, and for specific WAP instructions. There is a limit of (1) entry per person, per email address and per telephone number during the Promotion Period regardless of the method of entry. Additional entries beyond the specified limit from any person, email or wireless phone number will be void. Entries generated by script, macro or other automated means are not permitted and all such entries will be void. Entries by any means which subvert the entry process will be void.
Field Makeover Prize Winner Selection/Entry Periods: For each Entry Period listed below, one (1) potential Field Makeover Prize winner will be selected in an individual random drawing from among all eligible entries received during the applicable Entry Period for that drawing. Entries received during each Entry Period will carry forward to subsequent Field Makeover Prize drawing(s), all eligible entries received, winning and non-winning will be included in the Grand Prize drawing. Odds of winning will depend on the number of eligible entries received for the applicable drawing. Limit one (1) Field Makeover Prize per person, per household, and per valid email address. Eligible entries received during one Entry Period will carry forward to subsequent Entry Periods and will be included in the Grand Prize drawing. Drawings will be conducted in accordance with the Entry Periods outlined below, beginning at 12:00:01AM ET and ending at 11:59:59PM ET on the specified start and end dates, with the exception of 4/20/12 which will start at 10:00:01PM:

Potential Field Makeover Prize Winners will be contacted by telephone, U.S. mail and/or overnight express mail or email on or about winner selection dates stated above. Each potential Field Makeover Prize Winner will be asked to designate a local municipality or baseball non-profit organization. In the event that any selected potential local municipality or baseball non-profit organization authorized representative declines the prize, is not eligible to accept the prize, the local municipality or baseball non-profit organization does not comply with the terms and conditions of these Official Rules or the terms of the respective prize or if GM is unable to contact the potential local municipality or baseball non-profit organization within a reasonable time period then, subject to these Official Rules, the potential Field Makeover Prize Winner will receive the entrant component of the prize (as defined below); however, the respective prize for the local municipality or baseball non-profit organization in winner's community will be forfeited and GM, at its sole discretion and time permitting, may award the prize to an alternate local municipality or baseball non-profit organization.
Grand Prize Winner Selection: One (1) potential winner of the Grand Prize will be selected in a random drawing on/about 7/27/12 from among all eligible entries received for the Grand Prize Drawing. The Grand Prize Drawing will be conducted by Administrator, an independent sweepstakes management company. The first randomly selected potential Grand Prize winner that answers a telephone call placed by Administrator notifying him/her of his/her potential winning status and who agrees to accept the Grand Prize will be declared the potential Grand Prize winner (the "Grand Prize Winner"), subject to verification of eligibility and compliance with the terms of these Official Rules. Messages will not be left on answering machines or with live persons. In the event that any selected potential Grand Prize winner declines the prize, is not eligible to accept the prize, does not comply with the terms of these Official Rules or is not available for any reason when called, his/her prize opportunity will be forfeited and Administrator, at its sole discretion and time permitting, may randomly select an alternate potential winner from among all remaining eligible entries. Odds of winning the Grand Prize will depend on the total number of eligible entries received. The decisions of MLBAM and/or Administrator, as applicable, will be final and binding in all matters relating to this Promotion. The decisions of Sponsor, GM and/or Administrator, as applicable, will be final and binding in all matters relating to this Promotion.
Prizes: (12) Field Makeover Prizes: Each winner will receive a $1,000 Gift Card designated by Sponsor. In addition, a baseball or softball field makeover will be awarded to Field Makeover Prize Winner's designated local municipality or baseball or softball non-profit organization consisting of Scotts products and other products and services (to be designated by GM in its sole and absolute discretion) with a total value not to exceed $20,000. Field makeover will be awarded to the designated local municipality or baseball or softball non-profit organization at GM's discretion based upon consultation with field refurbishment experts (as designated by GM in its sole and absolute discretion) and an authorized representative of the local municipality or baseball or softball non-profit organization. ARV of each Field Makeover portion of the Prize not to exceed $20,000 each. Field Makeover Prize is subject to applicable laws, rules, regulations and approval(s) of the applicable jurisdiction(s) and authorities. Each local municipality or baseball or softball non-profit organization will be responsible for complying with all such laws, rules and regulations and obtaining the necessary approvals of the applicable jurisdiction(s) and authorities. Any other costs and expenses associated with prize acceptance and use will be the responsibility of the winning local municipality or baseball or softball non-profit organization. Any portion of the $20,000 not used will not be awarded. If at any time in the fulfillment and consultation process, any Field Makeover is determined to be unfeasible or cannot be awarded consistent with the terms of these Official Rules, as determined by GM, the field makeover experts and/or the representative of the applicable local municipality or baseball or softball non-profit organization, as applicable, GM reserves the right, in its sole and absolute discretion, to disqualify any winning baseball or softball non-profit. In the event any local municipality or baseball or softball non-profit organization is disqualified, prize will be forfeited and an alternate baseball or softball non-profit may be selected from among all remaining non-winning eligible entries. All prize details are at GM's sole and absolute discretion. Choice of local municipality, baseball or softball non-profit organization is subject to GM's approval. If there is no baseball or softball non-profit in any winner's community, GM reserves the right to identify another baseball or softball non-profit to receive the Field Makeover Prize. For the avoidance of doubt, no Field Makeover Prize will be awarded to any Field Makeover Prize Winner. Gift Cards are subject to certain terms, conditions and restrictions as specified by issuer. Field Makeover Prize winner will receive a 1099-tax form in the amount of $1,000.
(1) Grand Prize: 2013 Chevrolet Malibu 4dr Sedan ECO. ARV=$31,250. ARV based on 2013 Manufacturers Suggested Retail Price ("MSRP") of a base model with available manufacturer upgrades. Grand Prize winner has the option of selecting any other 2013 Chevrolet model vehicle (excluding commercial vehicles) whose MSRP does not exceed $31,250; however, if Chevrolet model is selected with an MSRP of less than $31,250 winner will NOT receive the difference in prize value. Grand Prize winner is responsible for vehicle registration, license, title and insurance fees and for all costs associated with any available upgrade/option packages and any other expenses related to the acceptance and use of the prize not specified herein. Winner must take delivery of Grand Prize vehicle within 30 days of notice of availability from a Chevrolet dealer near winner's residence, that Sponsor has selected, or the Grand Prize vehicle will be forfeited. Grand Prize winner shall be required personally to accept delivery of the Vehicle at designated location and present adequate personal identification. Released Parties are not responsible for delays in delivery of the Vehicle. Grand Prize winner will be required to provide proof of possessing a valid U.S. automobile driver's license in good standing as well as appropriate automobile motor vehicle insurance prior to the Grand Prize (also referred to herein as the "Vehicle") being awarded. If the Grand Prize winner fails to provide such proof of possessing a valid automobile driver's license and/or appropriate automobile motor vehicle insurance within five (5) days of prize notification, the Grand Prize will be forfeited and the prize may be awarded to an alternate winner. Grand Prize winner shall bear all risk of loss or damage to his/her Vehicle after he/she has taken delivery of Vehicle. Exact model, color, and options of Vehicle and exact Vehicle to be awarded are at the sole discretion of GM and subject to availability from manufacturer. EXCEPT AS STATED IN THE MANUFACTURER'S LIMITED WARRANTY FOR THE VEHICLE, THE RELEASED PARTIES MAKE NO WARRANTIES, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OR ENJOYMENT OF THE VEHICLE, INCLUDING, WITHOUT LIMITATION, THEIR QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Grand Prize winner acknowledges and agrees that installations or alterations to the original equipment vehicle or chassis as distributed by GM may void the GM New Vehicle Limited Warranty. Vehicle pictured in any advertising surrounding this Promotion may not be the actual Vehicle awarded. All prize details are at GM's sole discretion. Total ARV of all prizes: $283,250.
Miscellaneous: No transfer, assignment, cash redemption, or substitution of prize permitted except by Sponsor, GM and/or Administrator, who may substitute a prize (or portion thereof) with a prize of comparable or greater value at their sole and absolute discretion including, but not limited to, if the Vehicle is unavailable for whatever reason (except as otherwise provided herein). GM and/or Administrator reserve the right to change Vehicle and MSRP in their sole and absolute discretion, without notice. The potential Grand and Field Makeover Prize winners will be required to submit a valid social security number and/or other identification to Administrator and will be required to execute and return an Affidavit of Eligibility, Liability Release and (unless prohibited by law) Publicity Release within (2) days of date of issuance. For the Field Makeover component of a Field Makeover Prize an authorized representative of each of the winning local municipality, baseball or softball non-profit organization will also be required to execute and return any documentation or agreements within the timelines designated by GM as a condition of receiving the prize. Non-compliance with any of the foregoing timelines or these Official Rules may result in disqualification and, time permitting, awarding of prize to an alternate local municipality/baseball or softball non-profit organization at GM's sole discretion from among all remaining eligible entries for the applicable drawing. If any prize or prize notification is returned as undeliverable or if any potential winner/ local municipality/baseball or softball non-profit organization is not in compliance with these Official Rules, such potential winner and/or baseball or softball non-profit (as applicable) will be disqualified and, time permitting, an alternate winner and/or local municipality/baseball or softball non-profit organization (as applicable) may be selected for the prize at issue, at Administrator's sole discretion. By participating, each entrant agrees (i) to be bound by these Official Rules and the decisions of the Sponsor, GM and Administrator, as applicable, which are final and binding; and (ii) that MLBAM and each of its designees shall have the right and permission to use (unless prohibited by law) entrant's name, address (city and state of residence), photograph, voice and/or other likeness and prize information for advertising, promotional and/or trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation or consideration, permission or notification to entrants or any third parties. Released Parties shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury, death or damage to personal or real property, to entrant or any other person or entity due in whole or in part, directly or indirectly, from the preparation for or participation in this Promotion and/or by reason of the acceptance, possession, use or misuse of any prize (or any portion thereof) (including any harm or injury resulting from the use of any Vehicle or Field Makeover Prize, as applicable) and/or any travel or activity related to the receipt or use of any prize (or any portion thereof). Acceptance of a Field Makeover Prize shall be construed as and signify the corresponding winning local municipality/baseball or softball non-profit organization's agreement and consent that Sponsor, GM and each of its respective designees may use each winning local municipality/baseball non-profit organization's field name, image and/or prize information, for advertising, promotional and other purposes in any and all media now known or hereafter devised, worldwide in perpetuity, without further consideration, review, approval or payment, except where allowed by law. Each winning local municipality or baseball or softball non-profit organization and its respective representatives acknowledge that Sponsor and the other Released Parties have not made and are not in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize (or any portion thereof), including, but not limited to, its quality, condition or fitness for a particular purpose. Any and all warranties and/or guarantees relative to any prize (or any portion thereof), if any, are subject to the manufacturers' terms therefore and winners agree to look solely to such manufacturers for any such warranty and/or guarantee. Administrator and MLBAM reserve the right, in their sole discretion, to modify, terminate or suspend this Promotion (or any portion thereof) for any reason, including should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Promotion (or any portion thereof), in the event of termination at its discretion select the potential winners and potentially winning local municipality, baseball or softball non-profit organization, or youth baseball league from among all eligible, non-suspect entries received prior to event requiring such termination.
Released Parties are not responsible for lost, incomplete, late, inaccurate, misdirected, stolen, delayed, damaged, undelivered, or garbled entries or ballots, or for failures or malfunctions of phones, phone lines or telephone systems, cellular equipment tower, any error, omission, interruption, defect or delay in transmission, or communication; interrupted or unavailable network, server, Internet Service Provider (ISP), cable, satellite or other connections including those through and/or by any website; miscommunications, failed computer hardware or software or technical failures; non-delivery; misdirected, blocked, or delayed e-mail notifications; garbled, misrouted or scrambled transmissions; printing, typographical or other errors appearing within these Official Rules, in any Promotion-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, telephone (including wireless phones/handsets), electronic, mail or otherwise relating to or in connection with the Promotion, including, without limitation, errors or problems which may occur in connection with the administration of the Promotion, or the processing of entries, and/or any problems that may occur in connection with the events, the prize awards, or the announcement of the prizes. Administrator and/or MLBAM, as applicable, reserve the right, in their sole discretion, to void any and all entries of an entrant who Administrator and/or MLBAM, as applicable, believe has attempted to tamper with or impair the administration, security, fairness or proper play of this Promotion or who is otherwise not in compliance with these Official Rules. In the event of a dispute as to the identity of any entrant, the authorized account holder associated with the e-mail address submitted at the time of entry will be deemed to be the entrant and he/she must be eligible according to these Official Rules. "Authorized account holder" is defined as the natural person who is assigned to the e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Proof (to Administrator's satisfaction) of being the authorized account holder may be required by Administrator.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS PROMOTION IN ANY WAY, OR UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS PROMOTION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, ADMINISTRATOR, MLBAM AND/OR THEIR RESPECTIVE AGENTS WILL DISQUALIFY ANY SUCH ENTRANT AND RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS' FEES) AND/OR OTHER REMEDIES FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMISSIBLE BY LAW.
Arbitration: Except where prohibited by law, as a condition of participating in this Promotion, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.
Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA.
