1. ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN. The "Honda Opening Night Vehicle Giveaway" contest (the "Contest") is open to legal residents of Canada, excluding residents of the Province of Quebec, who have reached the age of majority in their province/territory of residence at the time of entry. Employees, officers, directors, agents and representatives and people residing in the same household of Honda Canada Inc. (the "Sponsor" or "Honda"), Rogers Blue Jays Baseball Partnership ("Blue Jays") and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Contest are not eligible to participate. The Contest is subject to all applicable federal, provincial and municipal laws and regulations. Void in Quebec and where prohibited or restricted by law, rule or regulation.
2. HOW TO ENTER: The "Contest Period" begins when Rogers Centre™ stadium (the "Stadium") gates open for the Toronto Blue Jays™ ("Team") home game on April 2, 2013 (the "Game") and ends at the end of the 7th inning of the Game. Limit of one (1) entry per person, regardless of the method of entry. If it is discovered that any person has attempted to obtain more than one (1) entry, then (in the sole and absolute discretion of the Sponsor) he/she may be disqualified from the Contest. There are two (2) methods of entry:
(A) In-Stadium Method. Each eligible individual (see Rule 1) who
(i.) holds a valid admission ticket to the Game,
(ii.) enters into the Stadium before the end of the first inning of the Game, and
(iii.) has his/her admission ticket scanned or torn by Stadium staff upon entry into the Stadium, will automatically be entered into the Contest.
(B) No Purchase Method. If you do not wish to enter as described in 2(a) above you may enter the Contest for free by filling out a ballot in full and depositing it in the ballot box located at Gate 13 between 5:00 pm and 7:30 pm during the Game. Ballot entrants must remain near Gate 13 until 7:45 pm to see if they are a selected as a Potential Semi-Finalist (as defined in Section 4(a)) for the Grand Prize Ceremony (as set out in Section 6 below). If a ballot entrant is selected as a Potential Semi-Finalist for the Grand Prize Ceremony he/she will be escorted into the Stadium by a Blue Jays representative to take part in the Grand Prize elimination draws.
3. Prizes
Grand Prize: There will be one (1) Grand Prize available to be won consisting of a 2013 Honda CR-V EX-L AWD (approximate retail value/MSRP $33,240.00 CDN) including freight and applicable taxes. All other costs associated with the prize, including licence, insurance and registration, shall be the sole responsibility of the winner. Colour and other specifics of the Grand Prize will be at Sponsor's sole discretion. Manufacturer's warranty applies to the Grand Prize. Upon notification, winner, or if winner does not have a valid driver's license and evidence of insurance, winner's designated agent with a valid driver's license and insurance who accompanies the winner, will personally take delivery of the vehicle from a Honda dealership within Canada reasonably close to the winner's home as designated by Honda within three (3) months of being confirmed as a winner in accordance with these Rules. Grand Prize will not be released unless winner or winner's designated agent first shows proof of having a valid driver's license for the province/territory in which he/she resides and provides evidence of satisfactory insurance. The Grand Prize will not be released without the winner being present and adequately identified to the satisfaction of the Sponsor. Winner is solely responsible for all expenses which are not included in the Grand Prize description above, including but not limited to: registration and license fees, insurance, additional accessories and all other costs incurred in claiming, registering or using the Grand Prize. Winner is responsible for all costs associated with any upgrade or option packages winner may request and which Honda, in its sole discretion, is willing to provide or has provided respecting any vehicle. Honda at its discretion may substitute a model year 2011 or 2012 vehicle of the same or like model and style in the event of lack of vehicle availability due to limited production or for any other reason.
Secondary Prize: There will be one (1) Secondary Prize available to be won consisting of a 2013 Honda CBR500RA Sportbike (approximate retail value/MSRP of $6,299.00 CDN) including freight and applicable taxes, and riding lessons having an approximate retail value of $500.00 CDN. All other costs associated with the prize, including licence, insurance and registration, shall be the sole responsibility of the winner. Colour and other specifics of the Secondary Prize will be at Sponsor's sole discretion. Manufacturer's warranty applies to the Secondary Prize. Upon notification, winner, or if winner does not have a valid motorcycle license and evidence of insurance, winner's designated agent with a valid motorcycle license and insurance who accompanies the winner, will personally take delivery of the sportbike from a Honda dealership within Canada reasonably close to the winner's home as designated by Honda within three (3) months of being confirmed as a winner in accordance with these Rules. Secondary Prize will not be released unless winner or winner's designated agent first shows proof of having a valid motorcycle license for the province/territory in which he/she resides and provides evidence of satisfactory insurance. The Secondary Prize will not be released without the winner being present and adequately identified to the satisfaction of the Sponsor. Winner is solely responsible for all expenses which are not included in the Secondary Prize description above, including but not limited to: registration and license fees, insurance, additional accessories and all other costs incurred in claiming, registering or using the Secondary Prize. Winner is responsible for all costs associated with any upgrade or option packages winner may request and which Honda, in its sole discretion, is willing to provide or has provided respecting any vehicle. Honda at its discretion may substitute a model year 2011 or 2012 sportbike of the same or like model and style in the event of lack of vehicle availability due to limited production or for any other reason.
Tertiary Prize: There will be one (1) Tertiary Prize available to be won of a lawn care package consisting of a Honda Trimmer, model #HHT25SLCT (MRSP $499.00 CDN), a Honda Lawnmower, model #HRR2169PKC (MRSP $569.00 CDN) & a Honda Tiller, model #FG110K1C (MRSP $579.00 CDN) (total retail value/MSRP of the Tertiary Prize is $1,647.00 CDN), including applicable taxes for each. Colour and other specifics of the Tertiary Prize will be at Sponsor's sole discretion. Manufacturer's warranty applies to the Tertiary Prize. Upon notification, the winner will personally take delivery of the Tertiary Prize from a Honda dealership within Canada reasonably close to the winner's home as designated by Honda within three (3) months of being confirmed as a winner in accordance with these Rules. The Tertiary Prize will not be released without the winner being present and adequately identified to the satisfaction of the Sponsor. Winner is solely responsible for all expenses which are not included in the Tertiary Prize description above, including but not limited to: registration fees, additional accessories and all other costs incurred in claiming, registering or using the Tertiary Prize. Winner is responsible for all costs associated with any upgrade or option packages winner may request and which Honda, in its sole discretion, is willing to provide or has provided respecting any element of the Tertiary Prize. Honda at its discretion may substitute a model due to limited production or for any other reason. Without limiting the generality of the foregoing, any costs or expenses incurred by the winner in claiming or using the Grand, Secondary or Tertiary Prize or any other expenses incurred by accepting the Grand Prize, Secondary Prize or Tertiary Prize are the sole responsibility of the winner unless otherwise stated in these rules. Grand Prize, Secondary Prize or Tertiary Prize must be accepted as described in these rules and cannot be transferred to another person, substituted for another prize, or exchanged in whole or in part, for cash, subject to the provisions set forth elsewhere in these rules.
4. Draws to Determine the Semi-Finalists:
(A) At the end of the first inning of the Game, ten (10) potential semi-finalists ("Potential Semi-Finalists") will be randomly selected via a draw from among all eligible entries received pursuant to Section 2 which information will be announced on the Main Video Board and PA announcement. The ten (10) Potential Semi-Finalists will be required to correctly answer a mathematical skill testing question and sign a publicity release and waiver before being confirmed as a Semi-Finalist for a chance to participate in the Grand Prize Ceremony ("Semi-Finalist"). In the event a Potential Semi-Finalist fails to correctly answer the mathematical skill testing question and/or does not sign the publicity release and waiver, another random draw will be held to select another Potential Semi-Finalist and this method will continue until ten (10) Semi-Finalists have been confirmed.
(B) In the middle of the third inning of the Game, a random draw will be held to randomly eliminate three (3) Semi-Finalists and the remaining seven (7) Semi-Finalists' section, row and seat number or name on the ballot entry will be announced again on the Main Video Board and PA announcement;
5. In the middle of the fourth inning of the Game, a random draw will be held to randomly eliminate four (4) Semi-Finalists and the remaining three (3) Semi-Finalists' section, row and seat number or name on the ballot entry will be announced again on the Main Video Board and PA announcement. These three (3) Semi-Finalists will be eligible to participate in the Grand Prize Ceremony to determine the selected entrant for the Grand Prize, Secondary Prize and Tertiary Prize.
The odds of being selected as a Semi-Finalist and participating in the Grand Prize Ceremony, depend on the total number of eligible entries received.
6. GRAND PRIZE CEREMONY
At the bottom of the seventh (7th) inning of the Game, each of the three (3) Semi-Finalists (or their authorized agent (s)) will participate in the Grand Prize Ceremony to determine the selected entrant for the Grand Prize, Secondary Prize and Tertiary Prize. Semi-Finalists who are not present or who have not responded to an in-game announcement or prior advice to present themselves at a specified time and location for preparation for the Grand Prize Ceremony will be represented by a member of the Blue Jays who will stand in and participate in the Grand Prize Ceremony on the Semi-Finalist's behalf. Each Semi-Finalist who has presented himself/herself in person must present adequate identification and meet all pre-qualifications before being permitted to participate in the Grand Prize Ceremony. In the absence of adequate identification a member of the Blue Jays will stand in for the eligible Semi-Finalist. Semi-Finalists/agents will be ushered to the Grand Prize Ceremony area. Off camera, the order in which the Semi-Finalists will participate will be determined by each Semi-Finalist picking a baseball from a secure bag which contains three (3) baseballs numbered one (1), two (2) and three (3). This will determine the order in which the three (3) Semi-Finalists will draw on-camera from another secure bag which contains twenty-five (25) balls each with one of the Team's twenty-five (25) man roster numbers on the balls.
At the bottom the of the seventh (7th) inning of the Game, each of the three (3) Semi-Finalists selected player numbers appearing on the ball they selected will appear on the Main Video Board, where a baseball spin wheel interactive will be on-screen. This spin wheel will feature all twenty-five (25) player numbers. The wheel will spin and will land on one (1) of the twenty-five (25) players numbers. The Semi Finalist whose baseball number is closest to the number on the wheel, without going over, will be the potential Grand Prize Winner. The Semi-Finalist whose baseball number is second closest to the number on the wheel, without going over, will be the potential Secondary Prize winner and the Semi-Finalist whose baseball number is third closest to the number on the wheel, without going over, will be the potential winner of the Tertiary Prize.
In the event all of the Semi-Finalists baseball numbers are higher than the number on the wheel, each Semi-Finalist will put their baseball with their player number into a secure bag and a representative of the Blue Jays or the Sponsor will pull one ball at a time from the secure bag. The Semi-Finalist whose baseball is pulled first will be the potential winner of the Grand Prize, the Semi-Finalist whose baseball is pulled second will be the potential winner of the Secondary Prize and the Semi-Finalist whose baseball is pulled last will be the potential winner of the Tertiary Prize.
In the event two (2) of the Semi-Finalists baseball numbers are higher than the number on the wheel, each Semi-Finalist will put their baseball with their player number into a secure bag and a representative of the Blue Jays or the Sponsor will pull one ball at a time from the secure bag. The Semi-Finalist whose baseball is pulled first will be the potential winner of the Secondary Prize and the Semi-Finalist whose baseball is pulled last will be the potential winner of the Tertiary Prize.
In order to be declared the winner of the Grand Prize, Secondary Prize or Tertiary Prize, the potential winners must meet all conditions as set out in these Official Rules and sign and return to the Blue Jays a Contest Winner Liability and Publicity Release within the time specified. The odds of a Semi-Finalist being a winner of the Grand Prize, Secondary Prize or Tertiary Prize is one (1) in three (3).
7. WAIVER OF LIABILITY/PUBLICITY RELEASE: By entering this Contest entrants accept and agree to (i) be bound by these Official Rules, including all eligibility requirements, (ii) the decisions of the Sponsor, Blue Jays and the independent judging organization, if any, which are final, binding and conclusive on all matters relative to this Contest; and (iii) waive any and all claims against the Blue Jays, the Sponsor and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Contest, and all of their respective officers, directors, employees, agents and representatives (collectively, "Released Parties") for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from their participation in the Contest or from the receipt or use of any prize or any travel or activity related to the receipt or use of any prize. Winner grants to the Blue Jays and the Sponsor and each of their respective designees the right to publicize their name, city and province/territory of residence photograph, image, likeness, any statements they may make regarding the prize, and/or voice for advertising purposes worldwide in perpetuity in any form of media including the Internet, without any form compensation or consideration, permission or notification, unless prohibited by law.
8. GENERAL CONDITIONS: Entries are subject to verification by the Contest organizers. The Released Parties are not responsible, and may not be held liable, for printing or typographical errors in any Contest-related materials or for stolen, late, lost, damaged, garbled, delayed, misdirected, incomplete, or illegible entries (all of which entries shall be automatically void and not eligible for a prize). The Blue Jays, the Sponsor and their respective agents and representatives are not responsible for incorrect, inaccurate transcription or loss or delay of entry or prize reply information, or for any technical or human errors associated with the Contest. If, in the exclusive judgment of the Blue Jays and/or the Sponsor this Contest becomes compromised in any way, the Blue Jays and/or the Sponsor reserves the right to withdraw the Contest offer, cancel any method of entry, to void any entries submitted fraudulently, select winners from all eligible entries received prior to the act that compromised the promotion or otherwise modify or correct the promotion within their reasonable discretion.
Persons who tamper with or abuse any aspect of the Contest or who are in violation of these Official Rules, as solely determined by the Blue Jays and the Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by the Blue Jays and the Sponsor or their agents and representatives. Any person entering this Contest or trying to do so by any means which go against the intention of these Rules and which would be unfair to the other entrants will be automatically disqualified and the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law - including criminal prosecution. The Blue Jays and the Sponsor shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Contest, and to resolve all disputes in their sole discretion. The Released Parties (i) make no warranty, guarantee or representation of any kind concerning any prize, and (ii) disclaim any implied warranty to the fullest extent permitted by law.
The Blue Jays and the Sponsor reserve the right, in their sole discretion, to cancel or suspend the Contest, cancel any method of entry or void any entries submitted fraudulently should unauthorized human intervention, or other causes corrupt administration, security, fairness, integrity or proper operation of the Contest. In the event of cancellation, the Blue Jays and the Sponsor may elect to identify the winners and award the prizes by way of random drawing from among all non-suspect, eligible entries received up to the time of such cancellations.
9. The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
10. In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control.
11. The Released Parties are not responsible for, and accept no liability in relation to, the Game being cancelled, postponed, delayed, rescheduled or otherwise affected in any way.
